If you are getting married and thinking about a prenup, you are definitely not alone in wondering how local this stuff really is. A lot of people hear the words “family law” and assume every county must have its own way of doing things. That would make sense, honestly. But when it comes to prenups in Pinal County, the big picture is actually pretty straightforward.

(480) 240-0040

INITIAL CONSULTATION

The main rules do not change just because you are in Pinal County instead of somewhere else in Arizona. Prenups in Pinal County are generally governed by Arizona state law, which means the same core rules apply across the state. So if you were expecting Pinal County to have its own special prenup rulebook, that is usually not how it works.

THE BASIC RULES COME FROM ARIZONA LAW

This is the part that surprises a lot of people. A prenup signed in Pinal County is still based on Arizona law, not a separate county law. So whether a couple lives in Pinal County, Maricopa County, or Pima County, the legal foundation is basically the same.

That means the agreement needs to be in writing, signed by both people, and completed before the marriage. It is also common for prenups to cover things like separate property, debts, business interests, real estate, and what each spouse wants to keep protected if the marriage ever ends.

So in that sense, no, Pinal County is not playing by a totally different set of rules. The law is statewide.

BUT LOCAL EXPERIENCE STILL COUNTS

Now, this is where things get a little more real world. Even though the legal rules are the same, the way a prenup is handled can still feel very different depending on the people involved. That includes the attorneys, the facts of the relationship, the financial situation, and how carefully the document was put together.

A prenup is one of those things that can look simple on the surface. Two people sign a document, problem solved, right? Not always. If the agreement was rushed, if one person did not really understand what they were signing, or if the wording is sloppy, that can create a mess later.

That is one reason local legal guidance still matters. You want the agreement to make sense for your life, not just sound official on paper.

OTHER STATES ARE WHERE BIG DIFFERENCES SHOW UP

If you compare Pinal County to another county in Arizona, the rules are mostly the same. If you compare Arizona to another state, though, that is where things can really start to change.

Different states can take different approaches to enforcement. They may look at fairness differently. They may handle financial disclosure differently. They may also treat certain spousal support terms in a different way. So while Pinal County is not really operating under its own prenup system, Arizona itself may be very different from California, Texas, or New Mexico.

That matters even more if one or both spouses have lived in other states, own property elsewhere, or may move in the future.

WHAT REALLY MAKES A PRENUP HOLD UP

Usually, the county is not the thing that makes or breaks a prenup. What matters more is whether the agreement was done carefully, voluntarily, and with full honesty about finances. A good prenup should be clear, specific, and written with enough thought that it still makes sense years later.

That is the real goal. Not just getting it signed, but getting it done right.

CALL TO ACTION

If you are thinking about a prenup in Pinal County, do not assume a generic form off the internet is enough. A strong agreement should fit your actual finances, your future plans, and Arizona law. High Desert Family Law Group can help you put together a prenup that protects your interests and gives you peace of mind before you say “I do.”

Couples who want to be clear and safe before getting married are increasingly using prenuptial agreements. Every state recognizes prenups, but the rules that regulate them are not the same in all of them. Arizona has a number of critical differences that can change how a prenup is written, enforced, and understood, especially when compared to other states.

What Is a Prenuptial Agreement?

Before getting married, people might sign a legally binding contract called a prenuptial agreement. It explains how property, debts, income, and some other financial duties will be handled if the marriage ends in divorce or death. Arizona law governs prenups, and they are usually enforceable as long as they meet certain legal standards.

The Laws About Community Property in Arizona

Arizona is a community property state, which is one of the greatest contrasts between it and many other states. This means that, unless there is a prenup, most of the assets and debts that the couple gets during the marriage are deemed to be owned by both of them and are usually split evenly in a divorce.

Couples in Arizona can change this default rule by signing a prenuptial agreement. Before being married, spouses can agree to keep specific property separate, set ownership percentages, or decide how income and debts would be handled during the marriage. In states that use equitable distribution instead of community property, prenups frequently emphasize on fairness rather than splitting things evenly.

Legal Requirements for Arizona Prenups

A prenuptial agreement is only valid in Arizona if it is in written and both parties sign it. People must agree to it freely, without any pressure, threats, or last-minute shocks. Unless both parties write down that they don’t want to follow this rule, full and fair financial transparency is also very important.

If a prenup is deemed to be unconscionable, which means it is very one-sided or fundamentally unjust, Arizona courts may not enforce it. Arizona doesn’t require notarization or a waiting time, but both are highly suggested to avoid problems in the future.

What Makes Arizona Different From Other States

Some states have extra restrictions that must be followed, including requiring notarization, setting certain times for things to happen, or making enforcement harder. Arizona’s provisions are rather clear, but courts nevertheless look closely at prenups, especially when one party later says they were unfair or didn’t comprehend them.

When couples migrate, there is another big difference. If a prenup is enforced in a different state, it may be looked at under that state’s laws. It can assist minimize confusion to include precise language indicating which state’s legislation applies.

What Prenups Can’t Cover

Arizona, like most other states, does not let prenuptial agreements decide who gets custody of the kids or who pays child support. The court must always resolve these things based on what is best for the child at the time of separation or divorce.

Speak With an Arizona Family Law Attorney

Prenuptial agreements can help you understand things better, protect you, and give you piece of mind, but only if they are written correctly and follow Arizona law. Little missteps might cause enormous issues down the road.

Call High Desert Family Law Group immediately to talk about if a prenuptial agreement is best for you and to make sure that your prenup is lawful, fair, and enforceable in Arizona.

The Average Time It Takes to Write a Prenup

It normally takes two to six weeks to write a prenuptial agreement from start to finish in simple instances. This covers the first meetings, getting financial information, writing the agreement, going over changes, and signing it. More complicated circumstances can take longer, especially if discussions are involved or if one or both parties own a lot of property.

Things That Change How Long It Takes

The chronology is affected by a number of things. One of the main problems is that everyone’s financial condition is different. Couples who own more than one property, have business interests, assets, or a lot of debt sometimes require additional time to completely disclose and deal with these problems.

How ready both sides are is also very important. The procedure goes considerably more smoothly when financial documents like bank statements, tax returns, and property records are organized and easy to find. Delays happen a lot when information is missing or takes a long time to get to you.

The level of agreement between the two sides is also important. If both people mostly agree on the conditions, writing it down can be rather rapid. Negotiations can add weeks to the timeframe if there are arguments about how to divide assets, spousal support, or future earnings.

What Legal Review and Independent Counsel Do

Each person should have their own lawyer for the prenup to be valid. This protects both people and makes sure that the arrangement is fair and legal. If you ask for changes, it can take longer to coordinate between two lawyers. But you shouldn’t speed through this phase; it’s quite important.

You Don’t Think Timing Is Important

It is very important to finish a prenuptial agreement long before the wedding day. People may be able to contest agreements signed too close to the ceremony because they were under pressure or didn’t have enough time to read them carefully. Starting the process at least three to six months before the wedding gives you more time and less stress.

Is it possible to speed up the process?

A prenup can be written up more rapidly in some cases, perhaps in as little as two weeks. This usually means that all parties and their lawyers need to be fully cooperative, have basic budgets, and be available right away. Even then, haste makes it more likely that you’ll make mistakes or face legal problems later.

Planning Ahead Leads to Better Results

Making a prenuptial agreement is not only a legal task; it is also a way to talk about money. Giving yourself enough time makes sure that everything is clear, that you make smart choices, and that your marriage has a stable basis. An expert family law attorney can help keep the process moving quickly while looking out for both parties’ best interests.

You cannot use a prenup to get somebody to marry you. Prenups cannot provide somebody with money, assets or other items as “payment” for getting married.

A prenuptial agreement saves you a lot of money and time should your marriage not work out. Usually referred to as a prenup, this document details how your assets and debts are going to be distributed if your marriage ends.

Couples getting ready to marry seldom want to think about the end of their marriage. However, it’s a fact that about half of all marriages end in divorce, even though divorce rates have fallen in recent years. Preparation for worst-case scenarios is key to anything in life. Marriage is no different.

What is a Prenup?

A prenup determines the financial and property rights of each spouse should the marriage end in a divorce. Prenups are similar to estate planning. You devise a will for leaving items to your children or heirs, guaranteeing each person gets an invaluable item. A prenup allows you to establish who gets what if you get divorced.

A prenup mulls over the end of your marriage so you can split assets with a neutral viewpoint. It could even help safeguard your business.

Prenups allow you to establish whether spousal maintenance (alimony) is going to be due if the marriage comes to an end and the amount and conditions of those payments. And they can establish what kind of bequeathals you leave to one another in your wills.

Should I Get a Prenup?

Should you be asking yourself: “Do I need a prenup?” You most likely do. It could be worth any early uneasiness to have a prenup’s possible value in the future. Prenups are increasingly viewed as a means to encourage trust and open communication concerning finances between spouses.

Prenups can be specifically useful for those trying to keep individual significant pieces of personal property, comprising of future inheritances and other anticipated income. This motivation is common among couples with a big age or wealth difference and among older or remarrying couples.

If a couple enters a marriage with few of these matters to address, prenups can be particularly important because their circumstances may change drastically. In fact, couples who still have a lot of their lifetime assets and debts in advance of them are some of the best contenders for a prenup.

How Much Does a Prenup Cost?

The cost of a prenup can differ wildly subject to your state, your lawyer and how complex your case is.

In some simple examples it could cost as little as five hundred dollars. In other cases, a prenup could cost between two thousand and six thousand dollars per person.

The cost really is subject to how sophisticated the agreement is, how organized the parties are and the cooperative character of the opposing lawyer.

Prenups Aren’t Just for the Rich

Whereas extremely wealthy people use prenups most often, typically to safeguard familial assets or wealth earned prior to marriage, prenups can be a good device for almost everybody. Even those of modest means can find benefit in a prenup.

Some people are concerned that devising a prenup will make it more possible they will divorce. If your relationship can’t endure financial planning prior to marriage, it probably won’t endure the financial difficulties marriage itself brings.

Safeguard Family Heirlooms

To clarify, your prenup doesn’t have to consider every item and asset you are the owner of, or every divorce situation. You can devise a prenup for one purpose‌.

If you acquired a family heirloom as an inheritance and want to be sure that if your marriage comes to an end, you’ll get to retain that item, you can create a prenup that declares that the family heirloom is yours. The prenup can also indicate that items you inherit throughout marriage are going to remain your individual property.

Pass Property to Children from Previous Marriages

A lot of prenups are used to determine property rights for second marriages. If you have children from a previous marriage, you may want to safeguard their interests in your property and assets.

Through a prenup, you can detail what property should remain separate from the marriage, safeguarding that property, should your marriage end. Merging this with correct estate planning, you can guarantee pre-marital property goes where you wish.

Clarify Financial Rights

Prenups are specifically for financial issues. Whether you come into the marriage with considerable assets or you have next to nothing, you can choose now how assets are going to be divided instead of waiting until divorce proceedings.

Whereas divorce may never come, working out the financial distribution sooner than later saves time and will lower stress. Contemplate the split now and hope you will never need to depend on your prenup.

Debt Safeguarding

Prenups also provide debt safeguarding, going side by side with defining financial rights. Many people get married with substantial financial debts or debts from student loans.

For those in this situation, they can enter a prenup and declare that those debts remain the individual responsibility of the spouse that incurred them. They can also decide how debts incurred throughout the marriage will be dealt with. Finances can create colossal issues in a divorce and making that clear now can be helpful and economical.

Avoiding Emotional Arguments

Divorce is going to be emotional. Even if you know it’s the right thing to do it’s still an overpowering and unsettling process.

When you are negotiating with your spouse concerning who gets what, emotions often run heated and could cloud your judgment concerning asset allocation. Reflecting on these items, thinking clearly is better for everyone involved.

How to Obtain a Prenup

You can have lawyers negotiate and create a prenup, or you and your spouse can devise your own.

How to Draft Your Own Prenup

Creating your own prenup, or any legal documentation, is not suggested. There are complicated state laws you are going to need to follow regarding the drafting and signing of a prenup. If you want to devise your own prenup, there are several items for you to consider.

Bear in mind that you are still going to need a lawyer to examine any prenup you create. You need a legal proponent to safeguard your rights and guarantee the contract is legitimate in your state.

Making Your Prenup Valid

Prenups are becoming more common, and courts eyeball them less than in the past. So, if you are creating your own, be sure you understand what you are signing.

When drafting your prenup, keep it concise. Don’t ‌write it in “lawyer talk” and make it unclear. That is just going to make a court question its legitimacy. In most states the agreement should not be signed instantly prior to the wedding since this could create intimidation.

A lot of states require that each party have their own lawyer review the document for it to be legitimate. Never sign a prenup without first comprehending your rights and making sure the agreement is legitimate. Be sure each of the parties sign the prenup. In some states, you may also have to sign in the presence of a notary public who will guarantee each person is signing without coercion.

Conditions in Your Prenup

Your prenup should examine property and financial rights. To be completely clear, you’ll need to provide each other with honest financial information and disclose all of your assets and liabilities.

A lot of prenups are going to include a stipulation stating both parties have been clear and honest. If it’s discovered that neither party was not, the agreement will probably be invalid.

You cannot use a prenup to get somebody to marry you. Prenups cannot provide somebody with money, assets or other items as “payment” for getting married.

Understanding Prenups

A prenup is a legal contract signed by two people before their marriage. Areas that are often covered in prenups include:

The division of property

Asset ownership

Inheritance agreements

Alimony agreements

The distribution of gifts

Tax responsibilities

Ownership of pets

In some cases, even infidelity!

Making Sure You Get an Enforceable and Legally Valid Prenup

You have to ensure your prenup is legally binding. While some states, California and Minnesota are just two examples have individual laws to follow when creating a prenup – let’s review the most frequent stated requirements in the majority of states:

The agreement must be in written form and signed (without coercion) by each party and must not be unconscionable in nature. Note in some states at least two witnesses also have to witness the signing of the prenup agreement

The document should be notarized. Although this is only mandatory in a small number of states, it is generally recommended

Both parties must provide a degree of financial disclosure

The prenup must not contradict current law or be illegal in any shape or form.

When Divorce Happens

You lived in marital bliss for a few years after signing the prenuptial agreement and adhering to all state prenuptial laws. Unfortunately, you are now facing the intimidating “D” word because you and your partner have become more distant. What takes place? There are two possible outcomes for your situation:

Path A: You and your spouse accept the conditions stated in the prenuptial agreement. Despite your distaste for the terms, you either have no reason to dispute them or are not inclined to do so.
Path B: One or both of you want to contest the prenuptial agreement for a valid reason because you disagree with its terms.
You will have a smooth sailing experience if you choose Path A. You and your spouse will adhere to the conditions specified in your contract, and your assets, alimony, and other issues will be resolved in accordance with those terms.

If you choose option B, you will need to either take the matter to court for a judge to decide or try to resolve any prenuptial disputes with your spouse through negotiation. As an illustration, suppose that John and Sarah have a prenuptial agreement that states that John is exempt from paying Sarah alimony. Sarah chooses to “fight” the prenuptial agreement because she wants alimony during the divorce. She now wants to argue that she signed it under duress, that it is unreasonable, that it is unconscionable, etc. The state’s laws will determine what she argues about having the clause or prenuptial agreement revoked. Remember that you cannot arbitrarily dispute a prenuptial agreement. To challenge the legality or enforceability of the contract, there must be a good reason.

John is now presented with two choices. Option 1: In order to avoid going to court, he could try to make a deal with Sarah and her attorneys. He could offer her more assets in the property division or pay her a lump sum. Alternatively, he could allow her to take her claim to court so that a judge can plan. Option 2 is typically more time-consuming, costly, stressful, and tedious. As you can imagine, it’s not easy to file a claim in a divorce court to enforce (or have thrown out) a prenuptial agreement. Additionally, it may result in higher legal bills for the attorneys attempting to challenge or defend the prenuptial agreement.

Do Prenups Get Thrown Out?

It is not common for prenups to be thrown out in courts. Generally, courts tend to uphold the status of an existing prenup not least of all because it lessens the work of the court and the amount of time a judge has to spend on a case. As long as the prenup is enforceable where you live, there should be no unforeseen problems.

Asset Division

Let’s illustrate with an example. Suppose your prenuptial agreement states:

John’s house, boat, and car are his separate property, while Sarah’s condo, jewelry, and art collection are hers. Their marital residence will be considered marital property and will be divided in accordance with state default law.

John and Sarah will each retain their separate property if the prenuptial agreement is upheld. Since the marital residence is regarded as marital property, it is the only item that can be divided. This implies that the division of the house will be determined by the default laws of the state in which they are divorcing. It depends on whether it is liquidated and the proceeds are divided or if one person takes the house and gives the other person a lump sum payment to offset the value. Additionally, state laws and the circumstances will determine whether the split is 50/50 or some other combination.

Recall that the United States has two frameworks for property division: equitable distribution and community property. This house will be divided 50/50 if you reside in a state where community property is allowed. Living in a state with equitable distribution means that the house will be divided “equitably,” which may not always be 50/50 based on the situation and state regulations.

Are Prenups Always An Equal Divide?

There is no automatic equal spit in a prenup. As long as it is legal, splits of everything can be weighed one way or the other. A court will not declare a prenup invalid on the sole basis it is not a fifty-fifty slit of everything.

Do You Need a Prenuptial Agreement?

In the past, prenuptial agreements were typically thought of as belonging to the very wealthy. But more and more people from all walks of life are using prenuptial agreements as their advantages become more widely recognized. Does this, however, imply that a prenuptial agreement is wise?

You should thoroughly comprehend the benefits and drawbacks of a prenuptial agreement, as well as what it can and cannot do, before deciding to get one. This blog discusses the advantages and possible disadvantages of prenuptial agreements, along with some of their most crucial features, to assist you in doing so.

A prenuptial agreement: what is it?

A prenuptial agreement is intended to assist prospective spouses in safeguarding their assets, outlining their financial situation in detail prior to marriage, and making future plans. To guarantee that the prenuptial agreement benefits both parties equally and does not unduly favor one over the other, each party must have their own legal counsel when drafting the agreement.

A prenuptial agreement may contain the following:

Each spouse’s contributions to the marriage
Any accumulated debt and any property you want to keep apart
Family property and assets
Commercial interests
Provisions for reserving assets for children from past partnerships
These are only some examples of what could be covered in a prenuptial agreement. You might also want to include clauses about financial expectations and marital duties. Last but not least, prenuptial agreements are frequently used to start the estate planning process, which includes details on how specific assets should be managed in the event that one spouse passes away.

What Is Not Allowed in a Prenuptial Agreement?

As you can see, a prenuptial agreement can cover a wide range of topics. A few significant issues, however, cannot be covered by the prenuptial agreement, and the courts will not uphold any clauses that address them.

A prenuptial agreement cannot contain the following:

Custody of children
Support for children
During the divorce process, both of these matters need to be addressed.

To find out more about the benefits and drawbacks of prenuptial agreements, continue reading.

Pro: Prenuptial agreements will safeguard your wealth.

The ability of a prenuptial agreement to protect your wealth and that of your future spouse is arguably its greatest advantage. Contrary to popular belief, this does not entail keeping your wealth hidden from one another. With the help of a prenuptial agreement, you and your future spouse can cooperate to safeguard the money you will earn during your marriage as well as the wealth you bring to the union.

Because it requires both parties to be forthright and honest about the assets and debts they bring to the marriage, a prenuptial agreement can accomplish this dual wealth protection. Additionally, the couple must talk about their financial expectations for these assets as well as any future assets they acquire together in order to create a prenuptial agreement.

A prenuptial agreement enables a couple to manage their wealth in the following ways:

Decide which property will be shared and which should be kept separate.
Describe each partner’s obligations with regard to the management of the couple’s assets and money.
Determine the rights of each spouse to oversee or manage any separate property or assets.
Create a strategy to deal with any debt that is brought into the marriage and any debt that may arise in the future.
Determine whether and under what circumstances a spouse will provide the other with alimony in the event of a divorce.
Discuss and determine how significant assets, like real estate, will be split in the event of a divorce.
Examine the anticipated outcomes of expected inheritances.
As you can see, a prenuptial agreement is not just for divorce planning; it can also be used for a variety of wealth protection purposes.

Con: It’s Not Always True in Court for Prenuptial Agreements

Prenuptial agreements are not always unchangeable, and the mere fact that you have one in place does not mean that the courts will follow it. A prenuptial agreement that benefits both parties will be robust and well-written. One party won’t be substantially disadvantaged over the other. Furthermore, the courts will not uphold a prenuptial agreement if it contains clauses or provisions that are illegal.

You must draft your prenuptial agreement with the assistance of an experienced lawyer to help guarantee that it will stand up in court. The lawyers at the Law Office of Alexandra White, PC, for instance, have assisted hundreds of clients in creating prenuptial agreements that were upheld in court and advantageous to both parties. Additionally, you should not draft a prenuptial agreement without legal counsel’s assistance or use online prenuptial templates.

Advantage: Facilitates Future Legal Procedures

As previously stated, a prenuptial agreement is not only utilized in cases of separation or divorce. In addition to making the divorce process less stressful and more seamless, a prenuptial agreement can also simplify your estate and end-of-life planning. In some respects, a prenuptial agreement gives you more options than a traditional will when it comes to leaving your children an inheritance.

A will doesn’t always give people the freedom they desire when deciding who they want to inherit their property because many states, including Colorado, have very strict inheritance laws. Nonetheless, the couple can jointly decide on these matters and, in some respects, get around the state’s inheritance regulations by signing a prenuptial (or postnuptial) agreement.

This is just one example of how a prenuptial agreement can help clarify and simplify future legal matters. Contact our legal team to find out more about this and how a prenuptial agreement could benefit you and your family.

Con: Indicates a Lack of Trust in the Partnership

This is not so much a real prenuptial agreement scam as it is a myth. Prenuptial agreements, regrettably, have a negative reputation. They are mistakenly perceived by many as being unromantic and signifying a basic lack of faith in the relationship. They don’t show mistrust or a lack of faith that the relationship will endure, even though drafting a legal document might not be the most romantic thing you can do.

On the contrary, a prenuptial agreement can strengthen a couple’s bond, promote candid communication, and aid in their future planning. All of this makes it possible for the couple to start their marriage on solid, equal ground. In fact, because a prenuptial agreement eliminated the possibility of future financial disputes, many couples felt more secure in their union.

How a Prenuptial Agreement Can Be Started

Most people can generally benefit from having a prenuptial agreement with their fiancé. You should think about creating a prenuptial agreement before getting married, even if you don’t have a sizable estate. You can draft a postnuptial agreement, also known as a marital agreement, if you are already married and wish you had a prenuptial agreement.

It is understandable why a soon-to-be married couple might believe that discussing a prenuptial agreement would be bad for their union. According to Sandy K. Roxas, Esq., a family law litigator and mediator from Torrance, California, “you’re basically negotiating what’s going to happen in the event of a divorce.” According to Roxas, some couples are afraid that discussing the prospect of divorce will cause them to split up later on, but it appears that the opposite may be true. “In my sixteen years of practice, only five percent of my premarital agreement clients have returned to file for divorce or legal separation, despite the fact that California has a divorce rate of over fifty percent.”

“Talking about a prenup compels partners to discuss their financial objectives, their overall financial attitudes, their spending and saving patterns, and any accumulated debts,” Roxas adds. “Having these discussions prior to marriage can help lay the groundwork for a stronger and longer-lasting union, as financial concerns are one of the main reasons for divorce.”

In addition to outlining a couple’s finances, the majority of experts concur that a prenuptial agreement can be a smart investment because it can prevent a costly and acrimonious divorce in the event that the marriage doesn’t work out. To help you navigate this pre-marital agreement, we have prepared a guide to address your questions. Continue reading to learn more.

A Prenuptial Agreement: What Is It?

An engaged couple’s rights and obligations with regard to premarital and marital assets and debts, as well as what would happen in the event of a divorce or death, are outlined in a prenuptial agreement, commonly referred to as a prenup. The premarital agreement is typically prepared by an attorney hired by the party with the highest income and/or assets. The other party would then hire independent legal counsel to examine and discuss the terms of the contract and offer recommendations for any necessary revisions, according to Roxas.

According to Barry Schneider, Esq., a divorce and family law lawyer in San Francisco, California, “after a draft has been approved by everyone, they and their respective attorneys would execute the agreement.” It must be demonstrated that a contract was not signed under duress, fraud, or undue influence, and that the parties were of legal age to enter into one.

The Distinction In Contrast to a Postnuptial Agreement

Similar to prenuptial agreements, postnuptial agreements (postnups) are negotiated after the parties have married. According to Atlanta, Georgia-based domestic relations and family law lawyer Elizabeth Green Lindsey, Esq., “they’re just as enforceable as prenuptial agreements.”

She goes on to say, “The reasons for getting one vary.” “Sometimes parties who were unable to finish negotiating the prenuptial agreement prior to the wedding will come back to it after the wedding; sometimes an inheritance is forthcoming and the parties want to address it; or sometimes a large liquidity event, like the sale of a company, is about to take place and the parties want to address what happens with the proceeds.”

The Prenuptial and Postnuptial Average Cost

Prenuptial agreements may cost $1,500 to $10,000, or more if the estate is extremely complex. According to Chicago, Illinois-based family law lawyer Alyease Jones, Esq., “a straightforward agreement can be drafted for a flat fee.” “However, lawyers usually bill on an hourly basis for more complex cases.”

However, because the parties are now married and must take marital property into account, postnuptial agreements may be more expensive. “A well-drafted agreement can be worth its weight in gold if there is a divorce, even though the process may seem needless, costly, and annoying,” Lindsey says.

A prenuptial agreement may be necessary in the following reasonable situations:

Either one or both of them are already married.

Former spouses might not want to get married again if they don’t know what their financial future holds, particularly if they went through a protracted and painful divorce. They don’t want a recurrence of the issues that can arise during the divorce process, according to Lois Brenner, Esq., a New York City mediator and matrimonial lawyer. “If someone believes their ex took advantage of them or got a better deal in a previous divorce, this is especially true.” Additionally, Jones points out that a prior divorce may have an impact on any future rights and responsibilities under a divorce decree or judgment.

One or both of the parties are parents.

A party will frequently wish to safeguard the financial interests of children from a prior marriage. According to Roxas, the premarital agreement can guarantee that assets stay separate property and enable the parties to establish a living trust or will to support their children in the event of their deaths. In the event that a parent passes away, having a premarital agreement may also avoid a dispute over a will. For instance, regardless of what you specify in your will, you are required to leave something to your spouse in New York State. According to Brenner, a couple may be able to circumvent this law through a prenuptial agreement.

One side has more money.

When there is a wealth gap between the two parties, prenuptial agreements are frequently used. In the absence of a prenuptial agreement, Lindsey says, “a person marrying into money may have a significantly improved lifestyle which can create rights for spousal support and property division down the road.” “Some people think that a prenuptial agreement guarantees that the parties are not getting married for financial gain.”

Although a prenuptial agreement can benefit both parties, usually the party with more property or the potential for greater income will request one. In certain cases, my clients’ wealthier fiancées have requested that they sign a premarital agreement. However, my clients end up being the wealthier party during the marriage term, and the agreement ultimately protects them as well,” Roxas says.

One side owes more money.

Typically, the person who incurred the premarital debts is responsible for paying them back. However, marital debts are frequently divided between the two spouses, which disadvantages the non-debtor spouse, according to Brenner. “A premarital agreement can help ensure that this does not happen if one party has a spending habit and the other party does not want to be responsible for debt incurred during the marriage,” Roxas adds.

According to divorce and family law lawyer Barry Schneider, Esq., the prenuptial agreement may stipulate that one spouse’s business debts cannot be settled with joint funds during the marriage or that one spouse’s premarital debts cannot be settled with the marriage’s joint community property. “If there is no prenuptial agreement, creditors can use later-acquired joint assets to collect premarital debts.”

A business is owned by one or both parties.

A prenuptial agreement may make sense if you owned a business prior to marriage because a divorce can ruin a family business. Additionally, if you co-own a business, your divorce may also affect their portion of the company. The parties may have complete control over how their business is run both now and in the future if they have a premarital agreement. According to Schneider, “if one spouse has established a business before marriage, that spouse may wish to prevent the other spouse from gaining an interest in the business during marriage.” When a business appreciates in value during a marriage and one spouse desires a portion of the increase, forensic accounting issues can arise. No matter what contributions were made during the marriage, a prenuptial agreement may allow the owning spouse to keep the business outright or it may quantify that interest.

One or both parties want to keep their personal life private.

The right to privacy is recognized in prenuptial agreements. “The parties can agree that, without the prior written consent of the other party, neither shall disclose, intentionally publish, or provide information or documentation to any other individual or entity,” says Roxas. There are often confidentiality clauses in prenuptial agreements to prevent, for example, social media exposure and tell-all books. “The parties can also contract to have any disputes handled by arbitration and therefore kept out of the public eye,” says Lindsey.

One or both parties have an inheritance to protect.

Generational wealth and future inheritance are two reasons why someone may want a premarital agreement. “If a party to the marriage receives an inheritance, it will be their non-marital property, unless they do something to make it marital—such as putting the funds in a jointly titled account or buying a piece of real estate in both names,” says Roxas. “The best way to avoid any unintentional transmutation of inheritance is to always maintain the inheritance in a separate account and only in the name of the person who inherited. That being said, a prenuptial agreement can, and often does, clarify if the inheritance of a party remains their non-marital property.”

One party plans on being a stay-at-home parent.

“If a party plans to be a stay-at-home parent, a prenuptial agreement can provide security that this spouse will be treated fairly in the event of a divorce. “A stay-at-home parent is foregoing work or career advancement to raise a child and this puts them at a disadvantage in the workplace should the marriage fail later,” says Brenner. “Couples often choose to compensate for this, if they can afford to, by providing a sufficient income stream and/or property to guarantee the homemaker a comfortable lifestyle or income after the child-rearing years are over if the marriage ends in divorce.”

Roxas agrees, saying, “A premarital agreement can protect the stay-at-home parent if the party is able to negotiate terms—such as an annual anniversary gift, an annual contribution to an IRA, a life insurance policy, or a monthly mandatory monetary contribution to a joint account by the spouse.”

How to Create Your Own Prenup

Given the advances in technology, there are several online platforms—such as Rocket Lawyer, Hello Prenup, and Prenup Planner—that now allow couples to create their own prenups. That being said, couples may not understand all of the legal ambiguities of an online prenuptial agreement. “An online form may be a useful stimulus to start you thinking about options, but if you’re going ahead with a prenuptial agreement, you’ll want to make sure it can achieve its intended goals,” says Lindsey. “The enforceability of a DIY prenuptial agreement will depend entirely on whether it meets the criteria of that state’s laws. How can you tell if it meets your state’s requirements to be enforceable? By hiring a lawyer!”

It is possible to write your own prenuptial agreement just as you can a do-it-yourself divorce. “But there are many subtle and not-so-subtle details that must be considered that a layperson may not think of or be able to figure out,” notes Brenner. “It may not be worth the risk that something will be incorrect or overlooked and come back to haunt you.” In fact, parties are usually more successful in challenging the validity of an agreement when they have drafted their own premarital agreement without legal counsel, warns Roxas.

How to Start the Prenuptial Discussion with Your Spouse

Many couples are hesitant to discuss prenuptial agreements for fear of upsetting their future spouse or damaging their relationship. However, effective communication between spouses is crucial for a successful marriage, even when discussing uncomfortable subjects. It speaks volumes about their future resilience if they can have this discussion in a healthy manner, according to psychologist Marcia Kimeldorf, Ph.D., director of clinical services at the Center for Anxiety in New York City.

“I suggest that the person who brings up the subject make it apparent that they sincerely hope the matter won’t arise and that the marriage will endure forever, and that it’s just being discussed and created as a precaution. Even if hurt feelings are evoked, it’s crucial that both parties feel heard and respected, says Kimeldorf. “The person who proposes a prenuptial agreement should do so in a loving manner, keeping each other’s best interests in mind.” When the time comes, be ready to listen and make an effort to comprehend your partner’s viewpoint without interjecting. Kimeldorf advises, “Be open to new ideas and compromises, but ask for what you want clearly.”

Before getting married, partners can better understand and support one another by talking about their financial expectations and differences. Additionally, if a financial conversation reveals a red flag or a contentious issue, it is beneficial for the couple to address it prior to marriage. Because, more often than not, a problem that one person dismisses as “not that big of a deal” can eventually grow into a larger one,” Kimeldorf continues.

Finally, keep in mind that the purpose of proposing a prenuptial agreement is to reach a consensus on how disagreements will be resolved, not to share the same opinions. Schneider adds, “Talking about these issues in therapy sessions can help some couples in premarital conflict cases.”

A postnuptial agreement: what is it?

In essence, a postnuptial agreement is a legal document in which you can outline specifics regarding matters like debt distribution, spousal support, and asset division in the case of a divorce—all before any legal action is taken.

You can draft a prenuptial agreement on your own or with a divorce lawyer’s assistance. You must adhere to any state regulations regarding the execution of the legal document in order for it to be legitimate and enforceable.

A few quick postnuptial facts

Without a lawyer, a postnuptial agreement can be made.

A postnuptial agreement can be made without first consulting a lawyer. Although this is feasible, it’s not always the best option. Given the complexities of state legislation and your financial condition, seeking professional assistance may be a prudent investment. You can arrange a free 15-minute phone chat with us to ask questions if you’re not sure.

First, you need to be aware of your state’s laws.

You need to become familiar with the particular rules of your state before you begin to draft a postnuptial agreement. The laws and regulations governing postnuptial agreements vary from state to state.

Here are a few standard prerequisites as a fast reference:

Written agreement: Postnuptial agreements must be in written and signed by both couples in every state.

Voluntary: The agreement must be freely and voluntarily entered by both parties.

Full disclosure: In most cases, it is necessary to disclose all assets, liabilities, and income in a complete and fair manner.

Fairness: There must be no egregious unfairness in the agreement.

The agreement ought to be mutually agreeable and equitable.

The agreement must be freely accepted by both parties, who must also fully understand its implications. Additionally, the agreement needs to be fair. Even though a 50/50 split isn’t required, it should be fair and acceptable given all the circumstances.

A court is likely to reject an agreement if it is one-sided or if there is proof of fraud, duress, or deception.

Division of property

Property split is one of the most crucial elements of any divorce. The house belongs to whom? The vehicle? What about the savings account?

You can save a great deal of time, money, and stress later on by having a postnuptial agreement in place that allows you and your spouse to agree on how to distribute your property in the case of a divorce.

Support for the spouse and alimony

A postnuptial agreement can help you and your spouse decide how to manage financial support if you ever find yourself in a situation where one of you is unable to work following a divorce. Without a postnuptial agreement, a judge may have to decide on spousal support, which may not be the best course of action for your financial circumstances.

Repayment of debt

Do you have any shared debt with your spouse? If so, a postnuptial agreement can specify in a divorce settlement who would be liable for paying back that amount. If one spouse is financially irresponsible or has poor credit, this can be very crucial.

Safeguarding company resources

In the case of a divorce or death, a postnuptial agreement can assist safeguard the assets of your business, whether you or your spouse own it. Without a postnuptial agreement, companies frequently find themselves in drawn-out, expensive legal disputes that divert important funds that could have been utilized to maintain the smooth operation of the company.

Advantages of hiring a lawyer

Having a lawyer draft your postnuptial agreement has the following advantages:

A lawyer can ensure that your contract is enforceable and lawful.

The knowledge of a lawyer might help you save time and stress if your financial situation is complicated (for example, you own several houses or enterprises).

It could be simpler to enforce the agreement in court if a law firm is involved.

It is always more expensive to hire a lawyer than to draft your own postnuptial agreement.

However, in the event of a divorce, a poorly drafted postnuptial agreement may potentially cause greater legal issues.

The advantages of doing things yourself

It’s a common misconception that couples need to employ a divorce attorney to draft their postnuptial agreement, but this isn’t always the case. You might be able to draft the agreement yourself if you and your spouse get along well and are able to discuss money matters honestly.

Saving money is the primary distinction and biggest benefit of creating your own postnuptial agreement. In the most straightforward cases, you might use an online template to establish a postnuptial agreement.

Additionally, drafting your own postnuptial agreement with your husband is quicker than hiring a lawyer. You might even be able to finish it in a weekend. (Just be careful to take care of any potential assets and debts.)

A comprehensive manual for creating a postnuptial agreement

Step 1: Recognize the goal
Understand why you are drafting before you begin. A postnuptial agreement is not about foretelling disaster or harboring mistrust. It’s about establishing clear expectations for the future and making sure that your financial affairs are understood by both parties.

Step 2: List all of your assets and debts.
Compile a thorough list of the assets and liabilities of each spouse. This covers debts, bank accounts, retirement savings, real estate, and investments. The foundation of every legitimate postnuptial agreement is full disclosure.

Step 3: Decide how to split the property.
In the event that the marriage dissolves, decide what will happen to those assets and obligations. The house belongs to whom? What is the distribution of retirement funds? Who takes on debt via credit cards? Additionally, take into account any family treasures. Consider more than just the expensive things.

Step 4: Take into account spousal assistance
Will one partner help the other financially in the event of a divorce? How much and for how long, if any? Here, clarity is essential.

Step 5: Write it down
Postnuptial agreements must be in writing and signed by both couples in every state. Thus, make your choices and write a thorough, understandable paper. Give specifics. Using ambiguous wording can cause problems later.

Without a lawyer, is it possible to draft a postnuptial agreement?

You can, indeed. But that doesn’t mean you should, at least not be aware of the complications and the consequences.

Establishing a grocery list is not the same as establishing a postnuptial agreement. It’s a legal document that could have a big impact on your future. Here, making a mistake is not only inconvenient, but also expensive.

The requirement that a postnuptial agreement be voluntary is among the most crucial things to keep in mind. This implies that there will be no duress, pressure, or coercion. The agreement must be voluntarily entered into by both parties. A court may reject the agreement if there is even the slightest hint of compulsion.

Complete disclosure is another requirement that cannot be negotiated. Each party must present all their financial information, including assets, obligations, income, and everything else. The agreement might be void if it turns out that one of the parties was concealing a secret bank account.

Lawyer-drafted versus self-drafted prenuptial agreements

The less expensive option is, of course, a self-drafted postnuptial agreement. There are many free templates and online tools available. However, value isn’t always synonymous with cheap. The financial consequences could be substantially worse than what you would have paid a lawyer if you make a mistake.

However, hiring a lawyer is not a cheap alternative. You might be looking at several thousand bucks, depending on where you live and how complicated your case is. This, however, is an investment in your future financial well-being. You’re spending money for knowledge, comfort, and a legally sound document.

Duration

A self-drafted postnuptial agreement may be quicker if time is of the essence. There’s no need to make appointments or wait for a lawyer to become available. The tempo is set by you.

Not to mention the time required to learn about and comprehend the rules of your state, compile all the necessary financial data, and create an extensive and understandable document. A lawyer can greatly expedite this process.

Enforceability

The validity and fairness of a postnuptial agreement determine its enforceability. A self-drafted agreement may be unfairly biased, omit important legal requirements, or leave opportunity for interpretation. These are all warning signs for a court.

An agreement drafted by a lawyer should meet all legal requirements and have a higher likelihood of being upheld in court. Attorneys are well-versed in family law. They know how to draft an equitable, well-balanced contract that is unlikely to be contested in court.

Do court cases uphold postnuptial agreements?

Yes, postnuptial agreements typically stand up in court. In some cases, though, a court might not uphold a postnuptial agreement. For instance, a court may decide not to enforce an agreement if it was not freely entered into or if it is unjust to one side.

Can a postnuptial agreement contain anything?

As long as both parties agree and the conditions are legal, most topics can be included in a postnuptial agreement. Postnuptial agreements frequently contain provisions pertaining to spousal support payments, business ownership, and the division of property in the event of a divorce.

For whom is a postnuptial agreement appropriate?

Given the high divorce rate and the sensitive nature of wealth division in divorce, any married couple may find it advantageous to have a postnuptial agreement. Nonetheless, they are particularly advantageous for couples who have previously been married or who hold significant assets.

What is the price of drafting a postnuptial agreement?

The cost of postnuptial agreements varies based on the state in which you reside and the agreement’s complexity. The average cost of hiring an attorney to prepare a postnuptial agreement is between $500 and $5,000.

What is the duration required to draft a postnuptial agreement?

The average time to draft a postnuptial agreement is one week to one month. You will need to allocate extra time for it if your case is more complicated.

Do both sides require legal representation?

Although it is not necessary, it is frequently advised that both parties retain legal counsel when drafting a postnuptial agreement. It is crucial that each party thoroughly comprehends the agreements before signing if neither has legal representation.

When planning to get married, couples might not even think about ever getting divorced. Nonetheless, many financial professionals recommend that everyone sign a prenup (prenuptial agreement) in the event a divorce happens. The marriage rate is 5 out of 1,000 people whereas the divorce rate is 2 per 1,000 people, both of which are lows for the last 5 decades. Nevertheless, those that do get married could benefit from a prenup and the expense to get one can widely differ. If this type of agreement seems like something you should seek, think about working with a financial planner that can help safeguard your financial assets.

What Is a Prenup?

A prenup, is a contractual agreement between potential spouses. These agreements usually list each of the spouses’ assets and dictate what should be carried out if either spouse passes away or should a divorce happen. Prenups are legally binding, and each state has separate rules that establish what prenups need to include.

A lot of individuals find a prenup useful since it can safeguard the assets of both soon-to-be spouses prior to them coming together in marriage, combining their assets. A lot of individuals perceive a prenup as biased with the wealthier soon-to-be spouse the one benefiting. Alternatively, a lot prenups are used for having a cordial separation should the marriage not pan out. Agreeing on how assets are going to be divided before you are married prevents a nasty divorce down the road.

How Much a Prenup Costs

Prenups can range in cost based on a multitude of factors. For a lot of couples, the cost usually ranges from $1,000 up to $10,000 for more convoluted divorces. Whereas there are forms and information available through the web, it’s a good idea to use a private attorney to guarantee that the agreement is legitimate and legally valid.

Factors that determine the cost of a prenup can be your location, how many assets and liabilities each party has, the practice and standing of the attorney you decide on and any lengthy negotiations. The couple’s assets and debts play a role in how long it is going to take an attorney to devise an agreement, so any couple with complicated assets might be charged more for the service.

Other considerations: For one or both individuals in a divorce, the prenup’s cost might wind up being lower than the expense of leaving the allocation of assets to a judge’s account of your state’s equitable distribution statutes.

Why Prenups Are Useful

A lot of individuals believe a prenup is only for highly wealthy people or for those that think divorce is in their future. Nonetheless, prenups can be useful in a lot of situations. For instance, suppose one or both of the individuals has children from a former marriage. In that situation, a prenup can assist them in clearing up the details on how they want to divide their assets if one individual pass away unexpectedly or when the couple gets a divorce. The same applies should one or both individuals receive an inheritance prior to the marriage that they want to safeguard.

Another instance is if one or both potential spouses have assets prior to the marriage or have considerable debt. They might want to safeguard the other from inheriting their liabilities or safeguard their assets by keeping them legally separated. Any assets or debt that spouses acquire throughout their marriage is community or joint marital property in many states.

Even though it’s a good idea for most soon-to-be spouses to get a prenup, they’re not appropriate for every couple. When a couple refuses to sign a prenup, they still might want to document all of their accounts in their current state prior to getting married. That way, they are going to know exactly what their assets are if they ever need documentation down the road.

How and When to Talk About a Prenup

Couples need to talk about a prenup prior to their wedding date. Acquiring a prenup is a multi-phase process, so it’s a good idea for soon-to-be spouses to talk about when and how they are going to get a prenup at least 30 days prior to their wedding.

The initial step to acquiring a prenup is to do research. Couples should understand what a prenup entails, and what they want to cover and learn more concerning attorneys that can carry out their prenup. A lot of states require that after a prenup is given to someone, they are required to take at least 7 days to go over it and pursue legal advice. Consequently, a lot of couples decide to have their prenups created months prior to their wedding.

In addition, prenups are not legally binding until the soon-to-be spouses get married. Every state has individual prenuptial agreement statutes, so they need to sure to investigate what the parameters are where they live prior to making any decisions to progress. It’s also wise to get legal representation for both parties throughout the process.

The Bottom Line

The cost of a prenup is going to depend on several factors. Consequently, it’s wise for couples thinking about marriage to investigate prenuptial agreements and their costs. A lot of individuals decide to get prenups to safeguard their soon-to-be spouse or safeguard their assets, families and more. Since every prenup is different, prenups differ in their cost. When soon-to-married people have additional questions, they may want to speak with a financial consultant and an attorney that can point them in the right direction.
