<p>Many people have heard of the term &#8220;marriage annulment,&#8221; but only a select few truly understand it. Forget what you may have seen on television about annulment. In fact, there are two types of annulments: civil and religious. An annulment of marriage is granted by a religious institution, such as a church and its clergy. Civil annulment is a court-ordered procedure that affects your legal civil status. This article discusses the civil annulment process.</p>
<h2>In Arizona, what is Civil Annulment?</h2>
<p>An annulment of civil marriage occurs when a court declares that a marriage is not valid but void. This means that the court legally declares that the couple was never legally married. It may be perplexing, but if what was considered a marriage was not obtained in accordance with Arizona&#8217;s legal requirements for marriage, the court has the authority to annul the union. This is analogous to a court &#8220;erasing&#8221; a marriage. It&#8217;s as if the marriage never occurred.</p>

<h2>Civil Annulment in Two Forms</h2>
<p>In Arizona, courts divide annulments into two categories: voidable marriages and void marriages. A void marriage is one that was never valid. Arizona has a list of marriage prohibitions, including incest, which renders a marriage null and void. If a biological brother and sister marry, the state will not recognize the marriage as valid, resulting in a void annulment. There are several additional grounds for declaring a marriage void, and you should consult a family law attorney for more information.</p>
<p>A voidable annulment occurs when one party petitions the court for an annulment. For instance, if one spouse was duped into marrying the other, the wronged spouse may seek a voidable marriage annulment. Deception grounds may include, but are not limited to, the failure of one partner to consummate the marriage by refusing to have sex with the other spouse at any point following the ceremony. Again, it is critical to consult with legal counsel prior to filing for annulment.</p>

<h2>Is Annulment Distinct from Divorce?</h2>
<p>Obtaining a divorce entails enduring frequently lengthy court proceedings in order to formally dissolve a marriage. The critical distinction between divorce and annulment is that in the former, the courts recognize the marriage as valid and thus require divorce proceedings to end it. Annulments do not necessitate protracted court proceedings. Once a judge declares a marriage null and void, it ceases to exist. It is typically much more expedient than traditional divorce litigation.</p>
<p>It is important to understand that not all annulments are painless and quick. There are very specific grounds for annulment. Without meeting the criteria for such a remedy, your case will be resolved in the same manner as everyone else&#8217;s.</p>
<h2>What Constitutes a Ground for Annulment?</h2>
<p>There is a list of &#8220;void and prohibited marriages&#8221; in Arizona law. Any marriage falling into this category is not recognized as valid by the state. Arizona prohibits marriages between parents and children, grandparents and grandchildren, full or half-blood brothers and sisters, first cousins (under certain circumstances), and uncles or aunts and nieces or nephews. In the past, same-sex marriages were also considered &#8220;void and prohibited.&#8221; Recent Supreme Court rulings, however, have altered that. Same-sex marriage is now legal and constitutional.</p>
<p>Other grounds for annulment include fraud, deception, coercion, intoxication (during the wedding ceremony), underage marriages without parental consent, mental illness, &#8220;mock&#8221; marriages, inability to consummate the marriage, bigamy, and incest. <p>If the couple has children, the annulment process will establish who is responsible for the children. When compared to divorce, annulment can result in significantly different property distribution outcomes in any divorce or annulment scenario.</p>
<h2>90 Days Wait</h2>
<p>Both you and your spouse have to reside in AZ for at least 90 days before filing.</p>
<h2>Get The Annulment Petition</h2>
<p>You will need to visit your local superior court to get the relevant forms. Some counties in Arizona have the forms online so you can download them.</p>
<h2>Complete The Petition</h2>
<p>Either party can fill the petition. You will have to explain the court why you are petitioning and for what legal reasons you are seeking an annulment.</p>
<h2>File The Petition</h2>
<p>File the petition with the clerk of the superior court in the county where either one of you resides. Fees will have to be paid and they can vary from county to county.</p>
<h2>Serve The Filed Petition</h2>
<p>The other party, known as the respondent, needs to be served a copy of the petition. There are specific guidelines to doing this that vary by county. After twenty days without responding, they lose their right to make a challenge to the annulment.</p>
<h2>Await The Response</h2>
<p>The spouse has twenty days to responds as we said above. They may wish to dispute the petition.</p>
<h2>Letter Review &amp; Hearing</h2>
<p>Check the letter from the court to confirm your hearing date and time. You do not want to be late. At the hearing, a determination will be made as to whether there is sufficient evidence to grant an annulment. Hearings may also be set to finalize asset division and child custody.</p>

<h2>Discriminatory Provisions</h2>
<p>Several provisions in a prenuptial agreement that a couple may have could be thrown out by a judge. Any divorce provisions must be reasonable and consistent with existing state laws. If a spouse&#8217;s infidelity is discovered, it may result in a spouse losing custody or visitation rights to a child or children.</p>
<h2>Lack of Assets and Infidelity</h2>
<p>In the event of infidelity, where one party is significantly wealthier than the other, the prenuptial agreement may stipulate that the other party receives only a portion of the other party&#8217;s wealth.</p>
<h2>Under Duress Signing</h2>
<p>If one party feels compelled to sign a prenuptial agreement, they can tell a judge about it during a divorce. However, if you have been coerced into signing something, you should contact a lawyer as soon as possible.</p>
<h2>A Swindling Arrangement</h2>
<p>If all assets and liabilities are not disclosed before the prenuptial agreement is signed, it may be void. This can also be the case if assets or debts have been misrepresented or exaggerated in some way.</p>
<h2>State Law Violations</h2>
<p>The prenuptial agreement must not be illegal under current state laws. Especially when it comes to property division, child visitation, or custody.</p>
<h2>Legal Representation That Is Appropriate</h2>
<p>If one of the parties does not have adequate legal representation, the prenuptial agreement may be thrown out by the judge. Each party must retain independent counsel who can fully explain the agreement and its terms and conditions to the person signing it. This can help prevent one of the parties to the agreement from making unreasonable demands. As a result, it is critical to have a lawyer review the document before agreeing to and signing it.</p>

<p>Minnesota, Ohio, and Wisconsin all need a five-day delay.</p>
<h2>How do I proceed if I&#8217;ve misplaced my marriage license?</h2>
<p>The procedures for acquiring certified copies of marriage records differ by state. Visit the National Center for Health Statistics&#8217; website to determine who you can write to, who you can contact, who you can fax, or who you can email to obtain the documents required in your state. <p>The law is becoming more favorable to prenuptial agreements as they become more popular. Traditionally, courts regarded prenuptial agreements with suspicion since they nearly usually entailed a less wealthy spouse waiving legal and financial benefits, and they were supposed to encourage divorce. Courts and legislators are increasingly prepared to uphold premarital agreements as divorce and remarriage have grown more common, and as gender equality has increased. Every state now allows them, albeit a prenuptial agreement that is found to be unjust or fails to meet state requirements will still be rejected. However, because prenuptial agreements are still scrutinized by the courts, it is critical that you discuss and draft your agreement in a clear, understandable, and legally sound manner. <h2>ARS 25-202 Enforcement of Premarital Agreements</h2>
<ol>
<li>A premarital agreement must be in writing and signed by both parties. The agreement is enforceable without consideration.</li>
<li>The agreement becomes effective on marriage of the parties.</li>
<li>The agreement is not enforceable if the person against whom enforcement is sought proves either of the following:</li>
</ol>
<ul>
<li>The person did not execute the agreement voluntarily.</li>
<li>The agreement was unconscionable when it was executed and before execution of the agreement that person:</li>
<li>Was not provided a fair and reasonable disclosure of the property or financial obligations of the other party.</li>
<li>Did not voluntarily and expressly waive, in writing, any right to disclosure of the property or financial obligations of the other party beyond the disclosure provided.</li>
<li>Did not have, or reasonably could not have had, an adequate knowledge of the property or financial obligations of the other party.</li>
</ul>
<ol>
<li>If a provision of a premarital agreement modifies or eliminates spousal support and that modification or elimination causes one party to the agreement to be eligible for support under a program of public assistance at the time of separation or marital dissolution, a court, notwithstanding the terms of the agreement, may require the other party to provide support to the extent necessary to avoid that eligibility.</li>
<li>An issue of unconscionability of a premarital agreement shall be decided by the court as a matter of law.</li>
<li>If a marriage is determined to be void, an agreement that would otherwise have been a premarital agreement is enforceable only to the extent necessary to avoid an inequitable result.</li>
</ol>
<h2>A prenup can cover the following:</h2>
<ul>
<li>Existing children</li>
<li>Plans for estates</li>
<li>Property held in the family</li>
<li>Financial assets</li>
<li>Debt liability</li>
<li>Property division</li>
<li>Saving and spending plans</li>
<li>Individual and group property ownership</li>
<li>Individual and group business ownership</li>
<li>An agreement once you are married is known as a postnuptial agreement and the terms are nearly identical to a prenup.</li>
</ul>
<p>It is a good idea to have a waiting period to finalize a prenup and consult an attorney who can describe the legal terms of the contact to you. The best prenups are arranged some time before the marriage so everyone can be fully aware of the terms.</p>
<h2>Prenuptial Agreement Benefits</h2>
<ul>
<li>When they are children from previous marriages, a prenuptial agreement can state what will happen to assets on the death of a parent, so the children are provided for.</li>
<li>The opportunity to examine financial circumstances and agree on financial responsibilities.</li>
<li>To avoid arguments in divorce cases.</li>
<li>To protect one another from each other’s debts.</li>
<li>If you do not make a prenuptial agreement, the law in your state will determined the division of property while you were married as well as what happens with your assets after your death, or even following the divorce process.</li>
</ul>
<h2>Amendment or revocation of agreement</h2>
<p>Arizona Revised Statute 25-204 states: After marriage, a premarital agreement may be amended or revoked only by a written agreement signed by the parties. The amended agreement or the revocation is enforceable without consideration.</p>
