<h2>What Happens to Our Property and Debt When We Divorce?</h2>
<p>The simplest way to resolve property issues during a divorce is to agree on a division plan. When divorcing couples are unable to reach an amicable agreement regarding how to divide marital property, the matter may be brought before a family court judge.</p>
<p>Property division is generally handled in one of two ways under state law:</p>
<p>Community property states include Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin, as well as the US territory of Puerto Rico. This essentially means that property acquired during the marriage is considered community property (although there can be exceptions). Generally, community property is evenly divided during a divorce, whereas separate property is retained by the owner.</p>
<p>Equitable Distribution: All other states, in general, follow an equitable distribution policy. Rather than halving the value of the property, a judge (or the couple themselves) will determine what is equitable or fair. In practice, this may mean that the spouse with the higher income receives two-thirds of the property and the other spouse receives only one-third.</p>
<p>Bear in mind that when courts divide property, this does not always mean that the property is literally divided (or physically). A court will determine the total value of the marital estate and divide it equally between the spouses. Each spouse is responsible for securing that amount in their own unique way, which may include selling a home, transferring a portion of an IRA, or purchasing out a spouse&#8217;s interest in a business. These are the details of property division that a divorce attorney can assist you with.</p>
<h2>How Is the Line Drawn Between Public and Private Property Defined?</h2>
<p>Unless otherwise specified, the term &#8220;community property&#8221; refers to all property, assets, and debt acquired during the marriage. For instance, a loan may have been made specifically for one individual. It could be due to their own indebtedness.</p>
<p>Separate Property: This term encompasses property acquired prior to the marriage, as well as gifts, court orders, inheritance, and pension proceeds received during the marriage. Separate property acquired continues to be distinct property (e.g., a boat bought with inheritance money).</p>
<p>Bear in mind that if separate property is commingled with community property, it becomes community property. For example, an inheritance may be used to pay off a mortgage, or a business may be started prior to marriage and sustained through the marriage.</p>

<h2>Who Gets the House in a Divorce?</h2>
<p>Whoever inherits the house is determined by circumstance. If there are no children, the marital home is divided differently by the courts.</p>
<p>Although neither party has the legal authority to request the other&#8217;s departure, one partner can always make the request. That said, they may be breaking the law if they lock you out before the divorce is finalized and you retain ownership of the home. If they do, you may contact the authorities. The obvious exception is when one partner has been served with a restraining order due to domestic violence.</p>
<p>Caution: At times, unhappy relationships can be extremely toxic. Make certain that you are not fabricating domestic violence in order to evict the other partner. If the judge believes you&#8217;ve done so, you risk losing your right to marital property, including the house.</p>
<p>If you and your spouse are unable to agree on who gets the house, the court will decide based on its rules, state law, and the state&#8217;s property system.</p>
<p>When parents have children, the parent who is primarily responsible for child rearing typically retains the marital home.</p>
<p>If one partner paid for the house outright and there are no children, they can generally keep it and require the other to vacate.</p>

			<h2>Dissolution vs. Divorce</h2>
<p>In a few states, dissolution of marriage is not synonymous with divorce, as it does not permanently end the marriage. Couples may use dissolution in some states only if they agree to it and how to resolve all of their divorce-related issues, such as child support, child custody, alimony, and property division.</p>
<p>On the other hand, an annulment effectively nullifies (or erases) a couple&#8217;s marriage. Legal separation is distinct from dissolution. A legal separation enables a couple to petition the court for determination of divorce-related issues such as child support and spousal support without ending their marriage legally for religious or other reasons. If a court approves a legal separation, the couple is &#8220;effectively&#8221; divorced, but neither can remarry until they file for dissolution.</p>
<p>In this article, we&#8217;ll focus on the more common usage of the term.</p>
<h2>How Does a Summary Dissolution Work?</h2>
<p>In some states, dissolution proceedings are referred to as &#8220;summary dissolution,&#8221; a type of expedited divorce. In a summary dissolution, the court is presented with a signed marital settlement agreement addressing child support, custody, property division, and alimony. By presenting the judge with the signed divorce agreement, you both agree to waive a trial or judicial intervention. Couples must meet the state&#8217;s requirements for summary dissolution in order to qualify for this accelerated legal process.</p>
<p>In California, for example, couples who meet the following criteria may use the state&#8217;s summary dissolution process:</p>
<p>Both spouses must meet the state&#8217;s residency requirements in order to divorce.</p>
<p>Both spouses concur on the legal justification for the request (irreconcilable differences).</p>
<p>The household has no minor children, and neither spouse is pregnant.</p>
<p>The marriage lasted a little over five years.</p>
<p>Neither spouse owns a home (except a current residence)</p>
<p>The couple&#8217;s marriage is free of debts totaling more than $4,000. (excluding an automobile note)</p>
<p>The couple does not own more than $25,000 worth of community property, and neither spouse owns more than $25,000 worth of separate property.</p>
<p>The couple enters into a contract dividing their marital assets and debts.</p>
<p>Neither party has made a spousal support request.</p>
<p>Both spouses agree to waive their appeal rights, and</p>
<p>Both partners consent to the dissolution of the marriage.</p>
<p>In states that recognize this type of divorce, the cost is significantly less than a contested divorce.</p>
<h2>Obtaining Legal Counsel</h2>
<p>Divorce can be challenging on a variety of levels, as it often involves complex and emotionally charged issues such as child custody and support, property and debt division, and alimony (also known as &#8220;spousal support&#8221; or &#8220;maintenance&#8221;).</p>
<p>As a result, spouses considering divorce may wish to consult with an attorney. <li>A mediator is not there for your interests &#8211; they have to act as a neutral third party and cannot suggest an agreement may not be fair. it has been known for mediators to push an unfair agreement just so they can call the mediation successful. <li>Mediation is often more expensive than litigation. Not only should you hire a lawyer not to so will likely be very disadvantageous and may lead to a settlement that is highly unfavorable. Without knowledge of the law, the assets of your partner, you can easily burn thousands of dollars, ending up with less than they did before.</li>

<p>To begin, keep in mind that while some states allow you to obtain a divorce without ever attending a courthouse, others require you to go in front of a judge. If you can settle your disagreements ahead of time, your court appearance will only take a few minutes, as opposed to the hours or even days that a contentious divorce trial will take. You and your spouse can try to work out your issues on your own, or you can employ an ADR technique (ADR).</p>
<h2>Solving Issues on Your Own</h2>
<p>If you and your husband get along, make a list of your marital concerns and try to reach an agreement on each one. To ensure that you don&#8217;t forget anything, conduct some preparatory research on the things you&#8217;ll be talking. Any or all of the following are common divorce concerns:</p>
<ul>
<li>Assets and obligations are divided.</li>
<li>alimony or spousal support</li>
<li>custody of the children, as well as</li>
<li>children&#8217;s assistance</li>
</ul>

The couple will prepare materials and documents ahead of time (such as tax records) and meet with the mediator as many times as necessary to reach an agreement. The objective is to keep the settlement parameters to a documented agreement.</p>
<p>A mediated divorce is frequently less stressful than a contested divorce. Sessions are typically held in the mediator&#8217;s office and are relaxed. Although the couple can have attorneys present, it is not required, which increases the cost-effectiveness of the mediation. (Having attorneys there can be counterproductive at times, especially if the attorney is combative.) You will be responsible for paying the mediator, which is usually shared between the parties.</p>
<h2>Collaboration to End Divorce</h2>
<p>Collaborative divorce is another sort of ADR. The goal is to reach an agreement, which is similar to mediation, but it is structured differently.</p>
<p>In a collaborative divorce, no mediator or other third party is involved. Instead, each couple hires an attorney and attends &#8220;four-way&#8221; discussions to come to an agreement. Attorneys that practice collaborative law often have particular training in this area. Most, if not all, jurisdictions prevent them from representing the spouses in future court matters if the negotiations fail. This is done to keep them focused on the settlement.</p>
<p>The premise of working as a &#8220;team&#8221; underpins collaborative law. All players must collaborate in order to reach an agreement. Any professionals participating in the process (such as accountants, property appraisers, and child psychologists if a custody dispute exists) must be objective and accepted by both parties.</p>
<p>You&#8217;re more likely to select collaborative divorce than mediation if you&#8217;d rather have an attorney represent you throughout the settlement process. However, keep in mind that if you can&#8217;t agree, you&#8217;ll have to start the divorce process all over again with new counsel. As these new lawyers will have to learn the case from the ground up, this could result in a significant rise in fees.</p>
<h2>Divorce Arbitration</h2>
<p>Divorce arbitration is another tool in the ADR toolkit, and it&#8217;s frequently utilized by couples who don&#8217;t think they&#8217;ll be able to settle their differences but want a decision made outside of the usual court system. Unlike mediation and collaborative divorce, the goal of arbitration is for the arbitrator to decide the case and make a decision, much like a court would after a trial. (Divorce arbitration isn&#8217;t available in every state; check with a local attorney to determine if it&#8217;s used in yours.)</p>
<p>There are various advantages to arbitration over a court trial. You and your spouse decide on the arbiter. In court, you can&#8217;t pick your own judge. You can also choose to deviate from the conventional proof rules. You can, for example, agree to accept the presentation of a witness&#8217;s sworn written statement instead of having them come in person. You&#8217;ll also work together to set the dates, times, and duration of your arbitration sessions. That&#8217;s a luxury you won&#8217;t find in court, where contested divorces can go on for months and you can squander hours waiting for a judge to appear.</p>
<p>The most serious disadvantage of arbitration is that the decision is definitive and irreversible. Normally, you can only appeal if the arbitrator has acted inappropriately. It&#8217;s almost a guarantee that you&#8217;ll be able to appeal if you have a court trial. In addition to your lawyers, you&#8217;ll have to pay the arbitrator. This can be expensive, especially in complicated situations.</p>
<h2>Is it required that you present in court?</h2>
<p>Even if your case has been settled, you must file a divorce petition or complaint with the court to formally end the marriage. The divorce is frequently filed on no-fault grounds (reasons), such as &#8220;irreconcilable disputes.&#8221; In areas where a court appearance is not required, you must submit the necessary papers and forms. These can be found on the court&#8217;s website quite frequently. If everything is in order, a judge will approve the settlement and issue a final divorce judgment.</p>
<p>Once you&#8217;ve completed the original divorce filing process and your state requires a court appearance, you&#8217;ll notify the court clerk that your divorce case has been resolved. The case will be labelled &#8220;uncontested,&#8221; and you will be assigned a court date that is less than a month away. In most circumstances, you&#8217;ll spend around fifteen minutes in front of a court, confirming the divorce reasons and answering basic questions concerning the settlement agreement. The court&#8217;s website, once again, is expected to give procedural information.</p>
