<li>Property Settlement (PSA) and</li>
<li>Marriage Agreement (MSA).</li>
</ul>
<p>The goal of this agreement is to document any agreements struck between divorcing (or separating) married spouses about child custody, child support, spousal maintenance, and property division.</p>
<h2>Before separating, must couples get into an agreement?</h2>
<p>No. You may enter into a divorce settlement agreement before to or after filing for separation or divorce. Or, you may not be able to reach an agreement until the morning of your court date – &#8220;on the steps of the courtroom,&#8221; as some might say. However, the sooner you resolve your case, the better off you will be, especially if you wish to avoid unnecessary suffering and attorney fees.</p>
<h2>Do I need a lawyer to draft the divorce agreement?</h2>
<p>It is strongly recommended that you hire an attorney to draft your Divorce Agreement. Or, if your spouse&#8217;s attorney has already drafted it, you must employ an attorney to review it (for you) and ensure that key legal conditions are added, deleted, or modified to safeguard your rights.</p>
<p>In fact, terms such as &#8220;sole legal custody,&#8221; &#8220;exclusive possession,&#8221; &#8220;timely indemnify and hold harmless,&#8221; and &#8220;relinquish and waive future claims&#8221; have substantial connotations. Remember that you are not an attorney, so you may overlook significant concerns with the proposed agreement or be unaware of the specific language that must be included to protect your interests. If you fail to locate something, you may lose essential rights. The wisest course of action is to pay a person up front to avoid incurring additional costs later.</p>
<h2>What Happens If We Settle Before Going to Court?</h2>
<p>A lawyer or mediator can draft an agreement when all issues are resolved outside of court. After being signed, the Divorce Agreement becomes a legally enforceable contract, requiring both parties to abide with its terms.</p>
<p>Subject to the laws of your state, the agreement can be brought to a court who can guarantee that the terms are fair. It will then be included in the divorce decision and constitute a binding court order; if either of you violates the order in the future, you could be placed in contempt of court.</p>
<p>When neither of you can reach an agreement, you will likely wind up in court, where you will have to argue your case and ask a judge to make a decision. Since this process is unclear and typically quite expensive, it is preferable to reach an arrangement outside of court.</p>
<h2>What If I Dislike My Spouse&#8217;s Proposed Divorce Agreement?</h2>
<p>Do not sign the document. Remember that it is only a recommendation — a starting point for the negotiations. Even when your spouse (or your spouse&#8217;s attorney) has given you a deadline for responding, you are not compelled to do anything. You may discard the proposal if you so choose. No one can force you to settle before you are ready.</p>
<p>However, there is such a thing as delaying too long. If you refuse to bargain seriously or refuse to sign anything because you want to continue exploiting your spouse&#8217;s goodwill for as long as possible, your spouse will get dissatisfied and may withdraw from settlement negotiations altogether. If you truly desire settlement, you must be willing to progress and compromise.</p>
<p>As previously said, it is prudent to have an attorney review your spouse&#8217;s proposed Divorce Agreement. If you detest it, the attorney can help you determine how far away you and the other party are and negotiate the best bargain for you.</p>
<h2>When I agree with my spouse&#8217;s proposed divorce agreement, do I simply sign it?</h2>
<p>Please refrain. Even if you are completely ready to move through with a settlement, if your spouse&#8217;s attorney wrote the first draft, it is crucial that you at least have the agreement reviewed by your own attorney &#8211; someone who is looking out for your best interests. You must do this regardless of any pressure to sign or your desire to &#8220;keep things simple&#8221; without using attorneys.</p>
<p>Remember that your spouse&#8217;s attorney does not represent you and does not care if the arrangement is fair or provides you with adequate financial resources.</p>
<h2>If we are in agreement, why can&#8217;t we create our own agreement?</h2>
<p>This is generally unwise. Overall, the agreement will not be specific to your state&#8217;s laws and may omit essential legal provisions. It may be obscure or unclear. If so, and if you and your spouse later disagree on a provision, you may end up paying additional money on attorneys to alter or clarify the agreement. A decent agreement is probably worth a few hours of an attorney&#8217;s time.</p>
<h2>If we both agree on everything, may we hire a single attorney to draft our divorce agreement?</h2>
<p>This is possible, but not advised. First, a single attorney cannot represent both spouses. Therefore, if you proceed without an attorney, no one will be looking out for your best interests. If your spouse continues without a lawyer, they may later claim that the agreement was unfair or that they did not comprehend what they were signing because they did not have a lawyer present.</p>
<p>If you and your spouse agree on every aspect of your divorce, the best course of action is to engage in divorce mediation, a process employing an impartial third-party mediator. The mediator collaborates with you both to develop and negotiate an agreement. Typically, the mediator will draft the Divorce Agreement, and then each spouse might request that their respective examining attorneys conduct a reassessment.</p>
<h2>What If We Both Decide Not to Follow the Divorce Agreement We Signed?</h2>
<p>You will not be arrested, nor will the globe stop spinning. For example, if you and your husband want to follow distinct alimony payment schedules, that is entirely your decision. However, be absolutely clear. If you decide to do something other than what you agreed to do in paper and then have a dispute with your ex-spouse, you both have the right to enforce the terms of the initial Divorce Agreement. This holds valid regardless of any verbal agreement to the contrary.</p>
<p>If you and your spouse agree to modify some of the more substantial terms of your first Divorce Agreement, you must formalize the change by revising the older agreement in writing.</p>
<h2>Can The Divorce Agreement Be Amended?</h2>
<p>Absolutely. Unless both parties agree to a change, terms pertaining to property, debt, and virtually all other financial problems are often regarded to be fixed in stone. In this instance, you can document the agreed-upon changes in a &#8220;Modification Agreement.&#8221; This revised Divorce Agreement must then be incorporated into a new court decree.</p>
<p>Child support, custody, and visitation agreements are modifiable if you can demonstrate a substantial change in circumstances since the entry of the initial order and/or that a new arrangement is in the child&#8217;s best interests.</p>
<p>Depending on the wording of the initial Divorce Agreement, alimony provisions may or may not be modifiable. Ensure that the terms of your first agreement clearly state whether spousal support obligations are modifiable or non-modifiable.</p>

<p>When custody orders are violated, it can result in criminal consequences in some cases, which is a highly contentious issue. However, there are a few circumstances in which it may be legal to temporarily interfere with the other parent&#8217;s custodial rights. The following are important facts to be aware of when it comes to custodial interference and what you can do about it.</p>
<h2>Custodial Interference Types</h2>
<p>Custodial interference can occur in a variety of ways. Some examples are as follows:</p>
<ul>
<li>While the other parent is supposed to have custody of the child or children, making a visitation on the child or children.</li>
<li>The refusal to release the child or children to the other parent when the other parent has a planned and scheduled visit.</li>
<li>Limiting the amount of time the child or children spend on the phone or online with the other parent.</li>
<li>Not returning the child or children for a scheduled exchange on time.</li>
<li>Using bribes to persuade the child or children to oppose the other parent.</li>
</ul>
<p>Custodial interference, on the other hand, is not illegal in some circumstances. Consider the following scenario:</p>
<ul>
<li>When you are attempting to protect a child or children from harm.</li>
<li>When pre-existing agreements cause custodial arrangements to be disrupted.</li>
<li>When unforeseen circumstances prevent a parent from transferring their child or children in a timely manner (bad weather being one example.)</li>
</ul>
<h2>Is There Anything That Can Be Done?</h2>
<p>Any instances of custodial interference can be reported to law enforcement and the courts by a parent. The courts will frequently attempt to resolve the situation. Here are some of the ways they try to accomplish this:</p>
<ul>
<li>Revisions and specific visitation orders are being implemented.</li>
<li>Creating make-up time for the purpose of visitation.</li>
<li>Family therapy or mediation is an option.</li>
</ul>
<p>More severe intervention may be required depending on the situation – a parent may request more relief. Here are some examples:</p>
<ul>
<li>Having third parties present during supervised visits.</li>
<li>A neutral location will be chosen for the child or children&#8217;s transfer.</li>
<li>Custody or visitation rights are reduced or lost.</li>
</ul>

<h2>Divorces that are contentious</h2>
<p>When you present the issues to a judge in court and you are unable to reach an agreement because there are too many disputed issues, the judge makes the final decision. Settlements will be negotiated and information will be exchanged. If no agreement can be reached, the case will be taken to court, and it will be critical to speak with an attorney to help you advance your case. Prepare to spend some cash.</p>
<h2>Divorces that are done in a cooperative manner</h2>
<p>In these situations, both parties retain legal counsel and work actively and cooperatively to resolve the outstanding issues. Each party agrees to full disclosure of information for the purpose of negotiations and meets with the other to reach an agreement. The majority of collaborations can be finished in three to four group meetings. If this fails, if your case goes to trial, both parties will agree to use different legal representation.</p>
<h2>Divorces without Fault</h2>
<p>Because of &#8220;irreconcilable differences,&#8221; this is commonly referred to as divorce. – The idea for this came from the idea that one of the parties could leave the marriage without the consent of the other. To put it another way, you can&#8217;t make someone stay married if they want to divorce.</p>
<h2>Divorces by Default</h2>
<p>The court may grant a divorce by default if one party fails to respond to the divorce petition. For example, if one party cannot be located and refuses to participate in the legal proceedings, a default decree against the non-participating party may be issued.</p>
<h2>Separation from the law</h2>
<p>Papers are filed with the court, and the court will make final decisions for both parties and allocate all assets and liabilities, much like a divorce. When this is done, both parties are still married, but they are legally separated, and they are no longer responsible for each other. Many couples choose this option to keep the other party&#8217;s health insurance after they divorce. Either party can &#8216;convert&#8217; the case to a marital dissolution at any time during the legal separation.</p>
<h2>The Goals And Procedures</h2>
<p>As a result, when a marriage ends, the parties and the court must deal with property division, child custody, child support, alimony, and the division of assets and debts. State laws presume that each party bears fifty percent of the blame for everything, including debts. Non-marital property that is intended for only one person will not be divided during the divorce.</p>
<h2>Marital Assets</h2>
<p>Unless otherwise stated, all property acquired during a marriage is considered marital community property, even if it is only in one party&#8217;s name. Property brought into the marriage relationship is treated the same no matter how long the marriage lasts or what kind of property it is. The court may attribute it to one party or the other in certain circumstances. Courts strive to be fair to both parties, and each party is responsible for fully disclosing all relevant information so that the court can make the appropriate allocation of the marital estate.</p>
<h2>Support for the Spouse</h2>
<p>Alimony, also known as spousal support, may be ordered by the court in cases where the parties&#8217; health and ages, as well as the length of their marriage and their living standards, are in question. This is not the same as child support. Spousal maintenance can last a few years or for an indefinite period of time. If either party&#8217;s circumstances change, the court may revisit the agreement or terminate it.</p>

			<p>In a few states, a dissolution of marriage is not the same as a divorce because the marriage is not permanently ended. Couples can only use dissolution in some states if they agree to it and how to resolve all of their divorce-related issues, such as child support, child custody, alimony, and property division.</p>
<p>In contrast, an annulment effectively nullifies (or erases) a couple&#8217;s marriage. Dissolution is not the same as legal separation. A legal separation allows a couple to ask the court to decide on divorce-related issues like child support and spousal support without ending their marriage legally for religious or other reasons. If a court approves a legal separation, the couple is &#8220;effectively&#8221; divorced, but neither of them can remarry until they file for a dissolution.</p>

<h2>How Does a Summary Dissolution Work?</h2>
<p>Dissolution cases are sometimes referred to as &#8220;summary dissolution,&#8221; which is a type of quick divorce in some states. In a summary dissolution, a signed marital settlement agreement addressing child support, custody, property division, and alimony is presented to the court. By presenting the signed divorce agreement to the judge, you both agree to forego a trial or judicial intervention. Couples must meet the state&#8217;s summary dissolution requirements to be eligible for this accelerated legal process.</p>
<p>&nbsp;</p>
<p>In California, for example, couples who meet the following criteria can use the state&#8217;s summary dissolution process:</p>
<ul>
<li>Both spouses must meet the state&#8217;s residency requirements in order to divorce.</li>
<li>The legal basis for the request is agreed upon by both spouses (irreconcilable differences).</li>
<li>Neither spouse is expecting a child, and there are no minor children in the house.</li>
<li>The couple has been married for less than five years.</li>
<li>Neither spouse is a property owner (except a current residence)</li>
<li>In their marriage, the couple has no debts totaling more than $4,000 dollars (excluding an automobile note)</li>
<li>In terms of community property, the couple owns less than $25,000, and neither spouse owns more than $25,000 in separate property.</li>
<li>The couple signs a contract that divides their marital assets and debts.</li>
<li>Neither party has made a spousal support request.</li>
<li>Both spouses agree to waive their appeal rights, and</li>
<li>Both partners agree that the marriage should end.</li>
<li>In states that recognize it, the cost of this type of divorce is significantly less than that of a contested divorce.</li>
</ul>

<h2>Arizona Collaborative Divorce And Divorce Mediation</h2>
<p>Collaborative divorce in Arizona is a private process that can pave the way to a peaceful divorce even if you and your spouse are not always on the same page regarding financial and child-related issues. Each spouse retains an attorney to represent their interests. In Arizona, divorce mediation occurs when a neutral third party works with both parties to facilitate agreement on divorce-related issues without the intervention of a judge.</p>

<li>Early marriage increases the likelihood of divorce, particularly during the early years of marriage.<br />
Reduced education. According to research, those with at least some college education (vs. those who only completed high school) have a lower risk of divorce.<br />
Income is reduced. Maintaining a modest income can assist couples in avoiding the stress that can result in divorce.</li>
<li>Cohabitation prior to marriage. Couples who cohabit prior to marriage appear to have a greater likelihood of divorce, but this is mostly true for those who have cohabited with multiple partners. While it is widely believed that living together prior to marriage allows couples to get to know one another better, research indicates that those who live together prior to marriage have already developed a degree of leniency toward divorce. This leniency toward divorce is what contributes to the couple&#8217;s high risk status. However, these findings are not without caveats. Couples who become engaged and then move in together are no longer at a high risk of future divorce, according to research. Their dedication to marriage reduces the likelihood of a future divorce.</li>
<li>Premarital pregnancy and childbearing. Prior to marriage, childbearing and pregnancy significantly increase the likelihood of future divorce.</li>
<li>There are no religious affiliations. According to researchers, those with religious affiliations are less likely to divorce than those who do not belong to any religious group.</li>
<li>Divorce of parents. Unfortunately, witnessing your parents&#8217; divorce doubles your risk of divorce. Additionally, if your spouse has witnessed their parents&#8217; divorce, your risk of divorce triples. This does not mean you are predisposed to divorce; rather, it means you should be more aware of marriage trends and work harder to ensure a successful marriage.</li>
</ul>

<p>7. How much do you anticipate this divorce will cost in total? (Don&#8217;t be shocked if most divorce attorneys refuse to answer this question because the level of conflict in your case has a significant impact on the cost of the divorce.)
