When a legal separation or separation orders are in place, the non-paying spouse may be held in contempt, which carries fines, penalties, and even jail time. While the spouses decide whether to remain married or divorce, a legal separation may bring some stability to an otherwise rocky relationship.

The filing of a Petition for Dissolution initiates a divorce proceeding in Arizona. The other spouse must then be served with the Petition for Dissolution, and they will have 20 days to respond. The second phase of a divorce begins once the initial pleadings have been filed. In this phase, formal discovery requests may also be issued. • Determine your assets, investments, and savings, as well as how you will share them. If necessary, enlist the assistance of a financial planner or other professionals.
• Determine what debts you have (overdrafts, credit card payments, etc.) and how you will divide them.
