Planning a divorce can at times be absolutely overwhelming. However there are things to consider and to prepare for. In this guide we look at some of those important issues. Read on to learn more.

It is not easy to decide to end a marriage. At this point in their lives, many people feel overwhelmed not only by their emotions but also by how complicated the process will be.

Whether this separation has been on your mind for years or it has suddenly become necessary, the foundation you set up today will support all that comes after it. Let’s look at the basic steps that can make a procedure that is naturally hard easier to deal with.

1. Your Money Situation

Before you file for divorce, it’s very important to fully grasp your financial condition. Many people who are getting divorced don’t know everything about their joint assets, investments, retirement funds, or property valuations. This lack of information can make talks much harder for someone and may even affect their financial stability for years to come.

Before you file, make sure you have a full picture of your finances. This entails getting your tax returns, investment statements, retirement account information, property deeds, mortgage documentation, and credit card statements. Write down both your assets and your debts—what you own and what you owe. Keep in mind that in most states, the division’s goal is fair distribution, which means fair but not always equal.

Making a sensible budget after the divorce is just as vital. Your finances will change a lot, and you may have to go from having two incomes to just one. Take into account new costs that weren’t a part of your married existence, such as separate housing, health insurance for each person, and maybe childcare bills. Think about what your life will be like six months and a year following your divorce, and then make plans based on that.

To be financially independent, you need to plan ahead. Before filing, many of our clients set up separate bank accounts and credit cards so they can get to their money during the process. Courts don’t like it when people hide their assets, but this phase is about making sure you have enough money to get through a time of change.

2. Who Is Going To Live Where?

Deciding where each individual will live is one of the most emotionally and practically important parts of divorce. The family house, which is generally the largest shared asset, is both a place to invest money and a place to feel safe. The decision of who stays and who departs is more than just a matter of preference; it also has to do with money, how close the children are to school, and sometimes safety.

When thinking about where to live, think about both your short-term demands and how long you can stay there. Can you pay the rent or mortgage with just one income? Will maintaining the house mean giving up money for retirement or school? Sometimes, emotional ties lead to financial choices that don’t work out years later.

For parents, decisions about where to live are even more important. Courts usually want children to have stable homes, which could affect decisions about where to live. The parent who stays in the family home usually has an edge in custody talks, but this is not the only thing that matters. Some customers choose “nesting” arrangements during the processes. This means that the kids stay in the family home while the parents take turns living there. This is a temporary option that gives the kids stability at a time of uncertainty.

Timing is important no matter what you do. Changes to your home without legal help can sometimes affect how property is divided or who gets custody. Talking to your lawyer before making big decisions about your residence can help you avoid problems that could affect your case in the long run.

3. Kids at the Center Of Decision Making

Divorce is much harder when kids are involved. The dissolution of a marriage does not mean the end of being a parent. When making decisions, courts always put the best interests of the kid first. They focus on what is best for the child’s physical and mental health, not what is easiest or most convenient for the parents.

Good co-parenting starts even before you file for divorce. You should think carefully about how to share important information about your children’s health, education, and emotional needs. Making it easier for people to share this knowledge without causing problems is good for everyone, especially your kids. Keep in mind that courts like parents who are eager to help their children get along with the other parent, even if they don’t get along with them personally.

Kids of different ages deal with divorce in different ways. Toddlers may fall behind in developmental milestones, and teenagers may show hostility or pull away. If you know how others will react, you can provide them the right kind of help. A lot of parents say that talking to child psychologists before telling their kids about their divorce helps them talk about it in ways that are acceptable for their age and don’t cause too much trauma.

Separating marital problems from parenting issues may be the hardest part. Kids do better when they don’t have to deal with their parents’ arguments, can love both parents without feeling bad about it, and have the same routines in both homes. More and more, courts support shared parenting agreements when they can, since they see how important it is for kids to have strong relationships with both parents.

4. Legal Help: Your Divorce Navigator Can Make The Divorce Path Easier

The laws on divorce are like a complicated ecology with its own language, rituals, and rules that aren’t written down. Without help from someone who knows what they’re doing, it’s easy to make mistakes that cost a lot of money. The lawyer you choose will have a big effect on both the procedure and the outcome of your divorce.

When choosing a lawyer, don’t just look for someone who has general family law experience; look for someone who is an expert in divorce law. During a divorce, the connection between a lawyer and a client needs more than just legal knowledge. It also needs clear communication, strategic thinking, and a good match of personalities.

The expense of hiring a good lawyer is typically much less than the benefits you get from it. Experienced lawyers find assets that could otherwise be missed, negotiate better support arrangements, and assist clients stay away from typical mistakes that can have long-lasting effects. The hourly charges may appear high, but going through complicated legal proceedings on your own is usually more expensive, both financially and emotionally.

5. Credit and Debt: How to Keep Your Money Safe in the Future

Divorce has immediate effects on your finances, but the effects on your credit can last for years after the divorce is final. To safeguard and understand your credit throughout this transition, you need to actively manage your joint accounts and set up your own credit in a smart way.

Joint credit accounts mean that both people are responsible for the debt, no matter who took it out or what your divorce decree says. Creditors know the names on accounts, but they don’t know the conditions of your divorce settlement. This means that your credit could be hurt if your ex-spouse doesn’t pay off debts that were assigned to them in the divorce. Close joint accounts before filing or change them to individual accounts whenever you can to avoid problems in the future.

Getting your own credit is especially vital if most of your accounts were joint or in your spouse’s name before. Before filing, we suggest getting your own credit cards and maybe a few small loans. Then, show that you can handle your money well to establish your credit profile. This phase is very helpful whether you need to find a place to live, go about, or buy other things that require credit.

When a couple gets divorced, they want to divide their debts fairly, but they need to think about both the law and the actual world. Sometimes it makes sense to take on a little more debt in return for a little more assets, especially if the debts have high interest rates or if making payments is hard because of your income. Your lawyer can assist you look at these trade-offs in light of your whole financial situation.

6. Being Strong Emotionally

Even the friendliest divorce is a huge loss of relationship, identity, future aspirations, and often even community. People generally pay less attention to the emotional parts of divorce than the legal or financial parts, yet they are the most important parts of the process that affect your capacity to make good decisions.

Before filing, it’s important to build a balanced support network. This will help you get through the tough times ahead. This network could include close friends who are always there for you, family members who help you with practical things, and professionals who give you unbiased advice. Many clients find it helpful to work with therapists who specialize in divorce transitions. These therapists give them strategies to deal with anxiety, sadness, and problems with co-parenting.

When things get really stressful, it’s easy to forget about self-care. But it’s still important to stay healthy physically and mentally when making big decisions. When everything else seems to be changing, simple things like getting enough sleep, working out regularly, eating healthy foods, and taking time to be attentive might help you stay stable. These aren’t extras; they’re things you need to do while you’re going through big changes in your life.

Setting emotional boundaries is just as crucial, especially when it comes to dealing with your soon-to-be-ex-spouse. Clear rules for communication, including just talking about child-related issues or having lawyers handle exchanges when things get tense, can help keep emotions from getting out of hand and affecting judgment. Keep in mind that the emotional effects of divorce remain longer than the legal ones. The choices you make during this time will affect your life beyond the divorce.

7. Paperwork: The Key to a Strong Case

In court, documents turn claims into proof. The way your records are organized and how complete they are can have a big effect on how quickly and well your divorce goes. Starting this organizational procedure before filing offers you time to gather materials without having to worry about court deadlines.

Important documents go beyond just financial records. They also include correspondence, calendars that show parenting time, records of contributions to the marriage, and proof of separate property. Using secure cloud storage to organize digital files protects them from being lost or destroyed during contentious procedures, which happens more often than most people think.

Putting in the time and effort to make complete records nearly always pays off in faster legal proceedings. When requests for information can be quickly met, there are fewer delays and fewer legal expenditures that go along with them. More significantly, good documentation makes your case stronger in negotiations, which often leads to better settlements without a long court battle.

A divorce settlement agreement is written documentation that varies in name depending on locale. Including:

Separation and Property Distribution

Property, Support, and Custody

Mediated Separation

Collaborative Agreement

Property Settlement (PSA) and

Marriage Agreement (MSA).

The goal of this agreement is to document any agreements struck between divorcing (or separating) married spouses about child custody, child support, spousal maintenance, and property division.

Before separating, must couples get into an agreement?

No. You may enter into a divorce settlement agreement before to or after filing for separation or divorce. Or, you may not be able to reach an agreement until the morning of your court date – “on the steps of the courtroom,” as some might say. However, the sooner you resolve your case, the better off you will be, especially if you wish to avoid unnecessary suffering and attorney fees.

Do I need a lawyer to draft the divorce agreement?

It is strongly recommended that you hire an attorney to draft your Divorce Agreement. Or, if your spouse’s attorney has already drafted it, you must employ an attorney to review it (for you) and ensure that key legal conditions are added, deleted, or modified to safeguard your rights.

In fact, terms such as “sole legal custody,” “exclusive possession,” “timely indemnify and hold harmless,” and “relinquish and waive future claims” have substantial connotations. Remember that you are not an attorney, so you may overlook significant concerns with the proposed agreement or be unaware of the specific language that must be included to protect your interests. If you fail to locate something, you may lose essential rights. The wisest course of action is to pay a person up front to avoid incurring additional costs later.

What Happens If We Settle Before Going to Court?

A lawyer or mediator can draft an agreement when all issues are resolved outside of court. After being signed, the Divorce Agreement becomes a legally enforceable contract, requiring both parties to abide with its terms.

Subject to the laws of your state, the agreement can be brought to a court who can guarantee that the terms are fair. It will then be included in the divorce decision and constitute a binding court order; if either of you violates the order in the future, you could be placed in contempt of court.

When neither of you can reach an agreement, you will likely wind up in court, where you will have to argue your case and ask a judge to make a decision. Since this process is unclear and typically quite expensive, it is preferable to reach an arrangement outside of court.

What If I Dislike My Spouse’s Proposed Divorce Agreement?

Do not sign the document. Remember that it is only a recommendation — a starting point for the negotiations. Even when your spouse (or your spouse’s attorney) has given you a deadline for responding, you are not compelled to do anything. You may discard the proposal if you so choose. No one can force you to settle before you are ready.

However, there is such a thing as delaying too long. If you refuse to bargain seriously or refuse to sign anything because you want to continue exploiting your spouse’s goodwill for as long as possible, your spouse will get dissatisfied and may withdraw from settlement negotiations altogether. If you truly desire settlement, you must be willing to progress and compromise.

As previously said, it is prudent to have an attorney review your spouse’s proposed Divorce Agreement. If you detest it, the attorney can help you determine how far away you and the other party are and negotiate the best bargain for you.

When I agree with my spouse’s proposed divorce agreement, do I simply sign it?

Please refrain. Even if you are completely ready to move through with a settlement, if your spouse’s attorney wrote the first draft, it is crucial that you at least have the agreement reviewed by your own attorney – someone who is looking out for your best interests. You must do this regardless of any pressure to sign or your desire to “keep things simple” without using attorneys.

Remember that your spouse’s attorney does not represent you and does not care if the arrangement is fair or provides you with adequate financial resources.

If we are in agreement, why can’t we create our own agreement?

This is generally unwise. Overall, the agreement will not be specific to your state’s laws and may omit essential legal provisions. It may be obscure or unclear. If so, and if you and your spouse later disagree on a provision, you may end up paying additional money on attorneys to alter or clarify the agreement. A decent agreement is probably worth a few hours of an attorney’s time.

If we both agree on everything, may we hire a single attorney to draft our divorce agreement?

This is possible, but not advised. First, a single attorney cannot represent both spouses. Therefore, if you proceed without an attorney, no one will be looking out for your best interests. If your spouse continues without a lawyer, they may later claim that the agreement was unfair or that they did not comprehend what they were signing because they did not have a lawyer present.

If you and your spouse agree on every aspect of your divorce, the best course of action is to engage in divorce mediation, a process employing an impartial third-party mediator. The mediator collaborates with you both to develop and negotiate an agreement. Typically, the mediator will draft the Divorce Agreement, and then each spouse might request that their respective examining attorneys conduct a reassessment.

What If We Both Decide Not to Follow the Divorce Agreement We Signed?

You will not be arrested, nor will the globe stop spinning. For example, if you and your husband want to follow distinct alimony payment schedules, that is entirely your decision. However, be absolutely clear. If you decide to do something other than what you agreed to do in paper and then have a dispute with your ex-spouse, you both have the right to enforce the terms of the initial Divorce Agreement. This holds valid regardless of any verbal agreement to the contrary.

If you and your spouse agree to modify some of the more substantial terms of your first Divorce Agreement, you must formalize the change by revising the older agreement in writing.

Can The Divorce Agreement Be Amended?

Absolutely. Unless both parties agree to a change, terms pertaining to property, debt, and virtually all other financial problems are often regarded to be fixed in stone. In this instance, you can document the agreed-upon changes in a “Modification Agreement.” This revised Divorce Agreement must then be incorporated into a new court decree.

Child support, custody, and visitation agreements are modifiable if you can demonstrate a substantial change in circumstances since the entry of the initial order and/or that a new arrangement is in the child’s best interests.

Depending on the wording of the initial Divorce Agreement, alimony provisions may or may not be modifiable. Ensure that the terms of your first agreement clearly state whether spousal support obligations are modifiable or non-modifiable.

The spouses will obtain automatic property rights under state law unless a legally binding agreement specifies otherwise. State law governs the division of property in the event of a spouse’s death or divorce. If the parties wish to distribute the property differently, a prenuptial agreement is required.

Here are some typical motives for drafting a prenuptial agreement:

Providing for children from prior partnerships

Maintaining financial independence. Certain forms of property acquired during a marriage automatically become part of the community or marital estate.

Interpreting financial obligations throughout a marriage.

Determining property rights in the event of divorce.

Why You Need a Lawyer When Drafting a Prenup

One of the most important reasons for engaging a prenup attorney is to avoid a court ruling that the prenup is unenforceable. Courts are more hesitant to enforce a prenuptial agreement executed by a party that was not independently represented by legal counsel. Under these conditions, particularly if the prenup appears unjust to the party without legal representation or if there are concerns about coercion or pressure, the court may properly reject the prenup.

In addition, each state often has tight implementation deadlines that must be met for a prenup to be considered valid. For instance, you may be obliged to implement it a particular number of days prior to the wedding, or you may be required to give each party a given amount of time to evaluate it prior to signing.

Preparing a Prenuptial Agreement

Before consulting with a prenup attorney, a couple must have a thorough understanding of what should be included in their agreement. Creating a summary of the terms is a useful method for drafting an impartial contract. A skilled attorney is familiar with the kind of terms that cannot be incorporated in a prenuptial agreement.

The courts will not enforce arrangements that waive future child support, limit future custody or visitation rights, or utilize financial incentives to encourage divorce. Moreover, situations including non-monetary factors: A court will not enforce a non-monetary condition and can even retain the entire prenuptial agreement if it stipulates the allocation of housework or the number of children. A court will not enforce a non-monetary condition and can even retain the entire prenuptial agreement if it stipulates the allocation of housework or the number of children.

When custody orders are violated, it can result in criminal consequences in some cases, which is a highly contentious issue. However, there are a few circumstances in which it may be legal to temporarily interfere with the other parent’s custodial rights. The following are important facts to be aware of when it comes to custodial interference and what you can do about it.

Custodial Interference Types

Custodial interference can occur in a variety of ways. Some examples are as follows:

While the other parent is supposed to have custody of the child or children, making a visitation on the child or children.

The refusal to release the child or children to the other parent when the other parent has a planned and scheduled visit.

Limiting the amount of time the child or children spend on the phone or online with the other parent.

Not returning the child or children for a scheduled exchange on time.

Using bribes to persuade the child or children to oppose the other parent.

Custodial interference, on the other hand, is not illegal in some circumstances. Consider the following scenario:

When you are attempting to protect a child or children from harm.

When pre-existing agreements cause custodial arrangements to be disrupted.

When unforeseen circumstances prevent a parent from transferring their child or children in a timely manner (bad weather being one example.)

Is There Anything That Can Be Done?

Any instances of custodial interference can be reported to law enforcement and the courts by a parent. The courts will frequently attempt to resolve the situation. Here are some of the ways they try to accomplish this:

Revisions and specific visitation orders are being implemented.

Creating make-up time for the purpose of visitation.

Family therapy or mediation is an option.

More severe intervention may be required depending on the situation – a parent may request more relief. Here are some examples:

Having third parties present during supervised visits.

A neutral location will be chosen for the child or children’s transfer.

Custody or visitation rights are reduced or lost.

In its most basic form, a divorce is a legal action that ends a couple’s marriage. It’s also known as a dissolution, and it’s a legal process that ends a marriage before either spouse dies.
Divorces that are not contested. If both parties are in agreement, this is the best option. The parties collaborate on the terms of the divorce and file the necessary court documents to formalize the divorce. You are unlikely to be summoned to court, and there will be no trial, no judge, and no waste of time or money.

Divorces that are contentious

When you present the issues to a judge in court and you are unable to reach an agreement because there are too many disputed issues, the judge makes the final decision. Settlements will be negotiated and information will be exchanged. If no agreement can be reached, the case will be taken to court, and it will be critical to speak with an attorney to help you advance your case. Prepare to spend some cash.

Divorces that are done in a cooperative manner

In these situations, both parties retain legal counsel and work actively and cooperatively to resolve the outstanding issues. Each party agrees to full disclosure of information for the purpose of negotiations and meets with the other to reach an agreement. The majority of collaborations can be finished in three to four group meetings. If this fails, if your case goes to trial, both parties will agree to use different legal representation.

Divorces without Fault

Because of “irreconcilable differences,” this is commonly referred to as divorce. – The idea for this came from the idea that one of the parties could leave the marriage without the consent of the other. To put it another way, you can’t make someone stay married if they want to divorce.

Divorces by Default

The court may grant a divorce by default if one party fails to respond to the divorce petition. For example, if one party cannot be located and refuses to participate in the legal proceedings, a default decree against the non-participating party may be issued.

Separation from the law

Papers are filed with the court, and the court will make final decisions for both parties and allocate all assets and liabilities, much like a divorce. When this is done, both parties are still married, but they are legally separated, and they are no longer responsible for each other. Many couples choose this option to keep the other party’s health insurance after they divorce. Either party can ‘convert’ the case to a marital dissolution at any time during the legal separation.

The Goals And Procedures

As a result, when a marriage ends, the parties and the court must deal with property division, child custody, child support, alimony, and the division of assets and debts. State laws presume that each party bears fifty percent of the blame for everything, including debts. Non-marital property that is intended for only one person will not be divided during the divorce.

Marital Assets

Unless otherwise stated, all property acquired during a marriage is considered marital community property, even if it is only in one party’s name. Property brought into the marriage relationship is treated the same no matter how long the marriage lasts or what kind of property it is. The court may attribute it to one party or the other in certain circumstances. Courts strive to be fair to both parties, and each party is responsible for fully disclosing all relevant information so that the court can make the appropriate allocation of the marital estate.

Support for the Spouse

Alimony, also known as spousal support, may be ordered by the court in cases where the parties’ health and ages, as well as the length of their marriage and their living standards, are in question. This is not the same as child support. Spousal maintenance can last a few years or for an indefinite period of time. If either party’s circumstances change, the court may revisit the agreement or terminate it.

When there are children involved in a divorce in Arizona, a court-enforced parenting plan is required. When parents are unable to reach an agreement on a child plan, the court will typically impose one on the parents for the children’s health and welfare. Unmarried parents, relatives, or other court-approved individuals may be granted custody or parenting time in some cases. Regardless of the facts, Arizona law demands that the child’s best interests take precedence above all other considerations.

When one individual has sole legal custody of a kid, this is referred to as sole custody. The court orders that one parent be responsible for making key decisions affecting the child’s care or welfare in this case. Although both parents are free to debate these issues, the court-appointed parent has the right to make final choices if the parents cannot agree.

Joint Custody

Also known as joint legal custody or joint physical custody, this kind of custody necessitates the submission of a parenting plan to the judge by both parents. Canterbury Law in Phoenix can help you through every step of the divorce and custody process.

Legal Custody

Legal custody refers to the situation in which one or both parents are accountable for the child’s care and welfare. “Sole legal custody” refers to when legal custody is granted to only one parent.

What does it mean to have “Joint Legal Custody”?

When a court gives joint legal custody, each parent has equal authority to make choices concerning the child’s care and welfare, and neither parent’s rights are superior to the other’s.

Joint Physical Custody

When a court awards joint physical custody, the kid’s physical residence is divided between the parents in such a way that the youngster has essentially equal time and contact with both parents. When parents share joint legal custody or when one parent is given sole custody, joint physical custody may be awarded.

In a few states, a dissolution of marriage is not the same as a divorce because the marriage is not permanently ended. Couples can only use dissolution in some states if they agree to it and how to resolve all of their divorce-related issues, such as child support, child custody, alimony, and property division.

In contrast, an annulment effectively nullifies (or erases) a couple’s marriage. Dissolution is not the same as legal separation. A legal separation allows a couple to ask the court to decide on divorce-related issues like child support and spousal support without ending their marriage legally for religious or other reasons. If a court approves a legal separation, the couple is “effectively” divorced, but neither of them can remarry until they file for a dissolution.

In this article, we’ll focus on the more common usage of the term.

(480) 240-0040

INITIAL CONSULTATION

How Does a Summary Dissolution Work?

Dissolution cases are sometimes referred to as “summary dissolution,” which is a type of quick divorce in some states. In a summary dissolution, a signed marital settlement agreement addressing child support, custody, property division, and alimony is presented to the court. By presenting the signed divorce agreement to the judge, you both agree to forego a trial or judicial intervention. Couples must meet the state’s summary dissolution requirements to be eligible for this accelerated legal process.

In California, for example, couples who meet the following criteria can use the state’s summary dissolution process:

Both spouses must meet the state’s residency requirements in order to divorce.

The legal basis for the request is agreed upon by both spouses (irreconcilable differences).

Neither spouse is expecting a child, and there are no minor children in the house.

The couple has been married for less than five years.

Neither spouse is a property owner (except a current residence)

In their marriage, the couple has no debts totaling more than $4,000 dollars (excluding an automobile note)

In terms of community property, the couple owns less than $25,000, and neither spouse owns more than $25,000 in separate property.

The couple signs a contract that divides their marital assets and debts.

Neither party has made a spousal support request.

Both spouses agree to waive their appeal rights, and

Both partners agree that the marriage should end.

In states that recognize it, the cost of this type of divorce is significantly less than that of a contested divorce.

Obtaining Legal Counsel

Divorce is difficult on many levels because it involves potentially complex and emotionally charged issues such as child custody and support, property and debt division, and alimony (also known as “spousal support” or “maintenance”), among others.

As a result, couples considering divorce might want to seek legal advice. An experienced family law attorney can explain each of these legal issues, as well as how they might play out in your case. An attorney can also prepare all necessary divorce paperwork and ensure that your rights are fully protected, whether you end up settling all issues with your spouse (outside of court) or going through a full-fledged divorce trial.

While couples exchange wedding vows with the intention of committing to each other for the rest of their lives, there may come a time when the marriage is better off ending. It is critical to weigh the benefits and drawbacks of divorce for yourself, your spouse, and your children. Divorce financially and emotionally divides a family, which can either improve or exacerbate existing problems. Prior to filing for divorce, weigh the advantages and disadvantages for all parties involved.

Disadvantage: Harmful to Children

Divorce affects more than just the couple divorcing; it affects the children as well. One disadvantage is that it will be harmful to children. According to researchers and psychologists at the University of Massachusetts Lowell, divorce can have a negative effect on toddlers and teenagers. Toddlers frequently believe they are responsible for the divorce, whereas teenagers may feel compelled to choose between their parents. A divorced child may develop issues with commitment and self-doubt regarding his marriage ability. Certain individuals may also experience depression as a result of the disintegration of their family.

The disadvantage is that it has an effect on adults’ psychological well-being.

A counter-argument to divorce is that it is detrimental to the psychological health of a couple. According to Arizona State University, “divorce has been ranked as the single greatest source of stress in a person’s life.” Adults can develop a negative psychological balance, manifesting as increased levels of anxiety, unhappiness, or depression. As a result, divorce can have a lasting negative effect on your psychological and emotional well-being.

Disadvantage Divorce is an expensive process.

While not every divorce requires $30,000 and months of wrangling, conflict, and heartbreaking betrayal, the reality is that some do.

Previously, divorce was identified as a disadvantage for children. However, there is a benefit to a child’s parents divorcing. A child who has experienced divorce may mature more quickly and develop a greater capacity for responsibility at a younger age. When a child’s father abandons her and she has younger siblings, she may be forced to share parenting duties with her mother. This exposure will instill a sense of responsibility in her that will serve her well in other areas of her life. Additionally, if their parents’ marriage is fraught with conflict, children benefit from divorce. Children should not be exposed to arguing and criticizing parents.

Advantage: Personal growth

A benefit of divorce is the opportunity for personal growth that the event provides. Divorced people report a greater sense of autonomy and personal growth than married people. This is because divorced individuals must develop self-sufficiency and learn to cope independently with the stresses of daily life. Following divorce, individuals can develop personal skills that will enable them to work toward a higher standard of living for themselves and their children.

As An Advantage, You Can Meet New People

Whether you married young and fell out of love, or you married later and feel settled, there are an infinite number of reasons to seek a divorce. One significant reason is a perception that the love you share with your spouse is simply not there. A peaceful divorce is a viable option that allows you to rebuild a healthy, fulfilling life with a new partner.

You may attempt to negotiate a settlement during a contested divorce, but if you are unsuccessful, you may be leaving the decision-making to a judge. Among these concerns are the following:

1. Matters pertaining to children, such as legal decision-making.

2. Parenting time and financial support for children

3. Financial issues, such as property and asset distribution

4. Debt allocation

5. Establishing spousal maintenance

Arizona Uncontested Divorce

If the terms of your divorce have been agreed upon from the start, your divorce may be considered “uncontested.” The paperwork establishing your agreements can be filed, and the case can be concluded without the involvement of a judge.

Arizona Collaborative Divorce And Divorce Mediation

Collaborative divorce in Arizona is a private process that can pave the way to a peaceful divorce even if you and your spouse are not always on the same page regarding financial and child-related issues. Each spouse retains an attorney to represent their interests. In Arizona, divorce mediation occurs when a neutral third party works with both parties to facilitate agreement on divorce-related issues without the intervention of a judge.

Arizona Default Divorce

If you file a Petition for Dissolution of Marriage in Arizona and your spouse does not respond within 20 days (30 days if your spouse lives out of state), you may be able to petition the court to proceed “by default.”

Arizona Legal Separation

In Arizona, the process of legal separation is similar to that of divorce in that the court enters orders governing legal decision-making, parenting time, and child support, as well as asset/debt division and spousal maintenance; however, the parties remain legally married at the conclusion of a legal separation, whereas the marriage is terminated at the conclusion of a divorce.

Do I Require the Services of a Divorce Lawyer in Arizona?

You may not require the services of a divorce attorney in Arizona to dissolve your marriage. However, there are some circumstances in which hiring a divorce attorney would be prudent. For instance:

Your spouse earned more money than you and you wish to seek spousal support.

You’re concerned about how to divide marital property and assets.

You or your spouse owe money and are unsure how to divide it.

You have children and would like to learn more about how child support will be determined.

Early marriage increases the likelihood of divorce, particularly during the early years of marriage.
Reduced education. According to research, those with at least some college education (vs. those who only completed high school) have a lower risk of divorce.
Income is reduced. Maintaining a modest income can assist couples in avoiding the stress that can result in divorce.

Cohabitation prior to marriage. Couples who cohabit prior to marriage appear to have a greater likelihood of divorce, but this is mostly true for those who have cohabited with multiple partners. While it is widely believed that living together prior to marriage allows couples to get to know one another better, research indicates that those who live together prior to marriage have already developed a degree of leniency toward divorce. This leniency toward divorce is what contributes to the couple’s high risk status. However, these findings are not without caveats. Couples who become engaged and then move in together are no longer at a high risk of future divorce, according to research. Their dedication to marriage reduces the likelihood of a future divorce.

Premarital pregnancy and childbearing. Prior to marriage, childbearing and pregnancy significantly increase the likelihood of future divorce.

There are no religious affiliations. According to researchers, those with religious affiliations are less likely to divorce than those who do not belong to any religious group.

Divorce of parents. Unfortunately, witnessing your parents’ divorce doubles your risk of divorce. Additionally, if your spouse has witnessed their parents’ divorce, your risk of divorce triples. This does not mean you are predisposed to divorce; rather, it means you should be more aware of marriage trends and work harder to ensure a successful marriage.
